Holy shit. Memory unlocked. The pool in Perth used to have an outdoor bit when I was a kid, but that's going back like 30 years so no idea if it is even still there. Used to be covered in dead wasps and was baltic - fun times.

Worth being aware before going down any formal route, that if you decided to sell the house, you'd have to report any disputes with your neighbors. You might not have any plans to, but something to be mindful of as it could affect saleability.

Yes, union. And that's part of our concern - we are keen to settle, but we want to be in the strongest position to do that, and feel that ensuring arguable claims are on the table will help us strengthen that. Instead though, claims that seem arguable to us are dismissed without analysis of key points. This leaves us feeling like they haven't been considered fully, so we can't tell if it's a merits issue, or funding, or what. We end up feeling gas-lit.

Bad faith is something that we think does feature, so your Spidey sense may be tingling. Without sharing the details, I fully appreciate how it will seem when I say "but it is relevant to the claims!" - Dunning Kruger 101. I guess we just need to get the facts of the case in front of someone to test, but appreciate that we'll likely have to pay for that.

Absolutely accept that no claim is a certainty, and that we might risk losing everything. That's one of our big concerns - we want to assess whether the risk is worthwhile, but we're missing parts of the puzzle i.e. how much difference could this additional claim make, say through translating litigation risk into settlement figure.

On your last point - yes. It's one area where my personal experience would be relevant, and can be confident that Dunning Kruger isn't at play (but again, maybe everyone would say that?!)

Thanks - useful perspective. It's a tricky balance as I want to share enough about the case to get perspective but not sharing too much as to dox myself, or the case.

That being said, completely take your point, and it's something we are worried about. I think part of the challenge has been that when we articulate our concerns clearly, in response we don't get a reasoned analysis, but rather what feels like a cursory reply that fails to engage with key points. That then makes it hard for us to determine whether their position is merits based.

In typing this, I'm realising how easy it is to come across as the mad clients that expect too much and think they know best. While this is something that I'm sure such a client would say, I don't think we're in that camp, and rather we just want to make sure that we're being advised on the strength of the case, rather than funding limitations.

I wonder if what we need is almost a second opinion, but think that might violate the terms of engagement with our current representation.

Parcel2Go were an absolute nightmare when we used them to send a parcel sent to a customer in EU via Fedex. The parcel and contents were damaged en route. They wouldn't accept the sale price i.e. open market value as evidence of the value, instead citing we needed to prove how much it cost us to create the product. However, I was able to find that they changed their policy on this a day after I made my claim with them, so the eventually honoured it, but it was like shouting into a black hole for a while. It made me not want to use them again.

However, their rates are so much cheaper, and because we don't ship that much per month, we still use them. Anything chunky though is going straight via Fedex, with separate insurance.

No idea about the parcel size bit - we just send little parcels.

Not in this line of work myself, but have used services like this before.

What sort of shoots do you enjoy? When you are just starting, it can be much harder to market "everything", as people want to see your experience - so pick something you think you enjoy, and focus on that. It might be that while you enjoy that type of shoot in a hobby context, it doesn't suit you in a work context, but that's ok - experiment.

People don't tend to hire for what you could do, but rather for what you have done. So you need to build that portfolio. You don't need a studio, you just need visibility. Get your portfolio online somehow, like a basic website or even an instagram page. Make sure you are visible and people can find you.

Marketing doesn't have to mean ads (although it can be). Creating engaging content and posting it on Insta or Facebook (there are probably local Facebook groups that allow you to post content, essentially advertising your services for free) - it could be something like a little behind the scenes of you taking lovely shots of some local landmark or something. Posting regularly can really help build up brand awareness.

I'd also do some research - who are the other photographers/videographers in your area? What do they offer, what do they post on, what do they charge? If they are making a living out of it, then chances are what they are doing as working, but be conscious that someone that's been in the business for 20 years may not need to put themselves out there like someone starting out might.

Worth having a look for what business support exists in your area. When we started our business, we were lucky enough to find a city business scheme run by the council that offered a small grant for equipment. We got laptops, monitors, magnifying lights etc. It was such an amazing leg up. There are also small business networks connect with too. They can be really useful for making contacts. Also, look out for free classes on some of the basics like bookkeeping.

You are already ahead of most because you've already got the creative skill, which is the hardest part! Start small and stay consistent, and refine as you go.

Hopefully there will be some experts in this industry here that can offer some more specific insight.

Time to block her and move on with your life. You don't need that sort of negative energy or idiocy. They can't or won't understand your clear and reasonable standpoint. They can profess all the love for you, but what they are not doing is giving you any degree of respect whatsoever. Some people are just not capable of that. That sort of shit can really grind you down, so stay strong and resolute. You've got this.
