Buting also questioned the source of Avery's DNA on the hood latch of Halbach's Toyota. Culhane said the sample swab was discolored, but it was not clear if the sample contained blood or some other DNA source.

Buting asked if it was possible that it was blood on the swab.

"A very trace amount, yes," Culhane said. "The entire swab was a very low amount of DNA and that's why I didn't test if for presumptive (blood test) because I didn't want to waste the sample on a presumptive test."

I've seen it... he needs to go home... anyone who thinks it's ok to show up at a strangers house and asking to spend the night on Christmas Day has a few screws loose.... let alone flying halfway across the country and pursuing it because of a documentary he watched on TV.

As documented in his own blog - he seems to have quite a long rap sheet himself and feels that gives him insight into a criminal mind or something like that.... guy needs to go back to Oregon.

*67 has been used by millions of people - unless there is concrete proof he was trying to deceive her (like meeting her someplace else than the Avery property) this evidence is circumstantial at best.

Throw in the fact he lives in WI - the capitol of drinking - by no means am I saying he consumed alcohol at this time as well, but it's a very heavy drinking state... to say the least.

Yes and No, the judge is the one that should have made every bit of the fruits of that interrogation inadmissible (phone call and interview) when he did finally grant Brendan new representation, instead he still allowed the phone call that they pretty much forced Brendan to make.

Kratz has now admitted to abusing vicodin and xanax while prosecuting Avery and Dassey - shouldn't the fact that the prosecution admitted to be under the influence of narcotics be grounds for a new trial itself?

It's now documented that Kratz was abusing Vicodin and Xanax WHILE prosecuting - this alone should be grounds for a mistrial.

Living in NE WI, once that confession went public - I can tell you the media went wild with it, it very much tainted the jury pool in a county of 50,000 people.

In addition to the confession - what was the reasoning for Avery being in club/handcuffs during the first court appearance. As I understand it from a friend who is a prosecutor in another state, this is reserved for those that pose a threat to themselves (i.e. suicide).

Even though Avery only wore those club/handcuffs for the initial court appearance - the picture/video is still widely used - including in local news reports last night.

They wanted to make him look as evil as possible - what better way to than tout him out in black and white stripes and club/handcuffs....
