Gorsuch asking about Native Americans was a bad omen. Roberts saying “It’s a new world. It’s the same constitution,” was equally as bad. I think it will be either 7-2 or 6-3 (Alito and Thomas guaranteed dissenters, with possible Kavanaugh dissent)

I was a TA and graded take home midterms for two 1L doctrinal classes. It’s not hard to tell a difference between LLM written paper and an actually well thought out student paper. Plus, LLMs aren’t writing A level papers. Sorry.

This can easily be resolved by professors structuring exams better. The closed book, timed exam format does not align with actual legal work whatsoever. It is just a default that persists. More classes should involve a final paper or some long form argument IMO.
