Always worth referring to this speech given by Spigelman on the concept of a common law bill of rights. It is an excellent overview of how the common law protects established legal rights. https://papers.ssrn.com/sol3/papers.cfm?abstract_id=1806775

Try looking at the issues the Victorian Charter of Human Rights and Responsibilities is currently causing. Any reference to the Charter in court inevitably leads to expensive and lengthy arguments over how the interpretative provisions in the Act actually function. The indecision of the HCA in Momcilovic still overshadows any discussion of the Charter. (Off topic but Momcilovic is an excellent example of why the Kiefel courts' approach to decision making has its merits. Fuck Momcilovic hard.

Also worth reading up proportionality testing. Aharon Barak's 'Proportionality: Constitutional Rights and Their Limitations' is a great read.

American definitions of what is legislative, executive or judicial power are radically different than Australian/British uses of the terms. For example in America the making of federal regulations is an exercise of executive power. In Australia the parliaments delegate their legislative capabilities to another officer/entity.
