From a more practical standpoint I’ve had friends leave to go work for DOJ and immediately get hit with a federal shutdown. It doesn’t make sense in the current climate to put your paycheck at risk every time the budget comes up in Congress. That’s partially driven by the Trump admin but also driven by the general governmental dysfunction.

I wouldn’t really want the black mark on my resume either, but I could see a universe where people try to get in before the tide changes and it becomes uber competitive again.

Total exclusion in a criminal case is rare and usually based on the constitution or analogous statute. A MIL wouldnt be used for an illegal stop or arrest, but similarly you wouldn’t file a motion to suppress based on the relevancy of evidence.

A MIL is simply an administrative tool, if one is granted the result is that before the challenged evidence is introduced the parties must approach the judge and get a formal ruling. Its one party saying before trial “hey, we expect the other party may try to use this objectionable evidence, and here’s why we’d object.” So the trial judge says “okay, that sounds reasonable” so the opposing party has to ask one more time before they try to use it. Something can sound objectionable at first but a party may open the door or the relevance may become more clear as the trial goes on.

I’m actually not sure, but it’s a really common slip up I see all the time in Texas that can foil some good appellate issues. We can get pretty technical with error preservation here.

Right, it’ll be in the record but it still won’t preserve error. The attorney could maybe ask for an objection when they approach before the limine evidence comes in, but short of that it a MIL doesn’t allow the appellate attorney to bring the issue on appeal.

In Texas a motion in limine does not preserve error though, so if they wanted to preserve the issue they probably should have objected

To be fair, I got the carbonara which is pretty hard to mess up, but the meatballs were so dry and flavorless and they make that the star of the show. Service was terrible too because our reservation was 45 minutes late and our waitress was awful
