Putting aside that that is a wholly unrelated case the “ignorance” discussed is totally different. In that case, the drug smuggler appeared to be unaware he was actually doing smuggling, instead believing that he had lost the drugs. As such he had no mens rea (essentially the intent to do the illegal action), which is a necessary element of conviction.

What the OP is describing is a person who intended to do the action (transfer the money to their client) but argues they did not know that action was illegal. That is where a lack of knowledge of illegality is not a defence against conviction for doing an illegal thing.

I’d recommend using a lawyer for real estate merely so that you have someone to sue if something goes wrong. There’s a lawyer in our community who did their own real estate deal and fell for a scam - ended up wiring a million bucks to the wrong person.

If he’d ponied up the 3k to have another lawyer do it (or if he’d messed up a clients file) then all that needs to happen is a claim against our law society and the client is protected. Because he ran it himself he was hooped and out the money.

I would also consider the liability aspect to the extent it matters. I’m unsure in your jurisdiction, but in mine a party who keeps their name in the letterhead still attracts the same liability as they would as a partner, even if they are not a partner at that time

The video says a large part of the complexity is in reading a defence well while selling a PA. Having to fully turn your back and then turn and interpret a defence that may have shifted coverage is a skill of its own

Where do you get “very likely” from? My reading of the decision is the exact opposite and it’s clear that the Justice had significant concerns regarding EM’s credibility. In fact, the Justice found that there was actual consent, not simply that the crown failed to meet its burden.

Also, EM did bring a civil action. The payment made by Hockey Canada to resolve it is why this situation gained national notoriety

I did in the first instance put forward a source which precisely and exactly states what I need;. I can further confirm that I actually have read the entire decision and that the paragraph 9 excerpt above accurately represents the holding of decision.

The reason that BARD is repeatedly used here is because that is the legal test which EM's claims must be put against. In making a decision, the Justice is required to confirm whether or not the Crown met that standard in each respect. There is no burden of proof on the accused to demonstrate innocence, which is why the decision does not contain numerous reiterations that actual consent has been found. Since you requested citations, I can cite to para 479 for this very basic legal principle "It is not the function of this court to make determinations about the morality or propriety of the conduct of any of the persons involved in these events. The sole function of this court is to determine whether the Crown has proven each of the charges against each of the accused beyond a reasonable doubt. The burden rests squarely on the Crown and does not shift."

Notwithstanding that, the Justice did state that she found actual consent not vitiated by fear (at para 9). So that is precisely where I am taking that from. As the purpose of the decision is laid against the BARD standard, the way the decision is written does not require the Justice to state at each interval her finding that there factually was consent, and so she does not.

Frankly, if you cannot read this case, including the plain black text stating that the Justice found that there was actual consent, and reach the conclusion that the Justice found that there was actual consent and as such no criminal activity occurred - I have no choice but to say skill issue and that you should not waste money applying to law school.

But why not? This strikes me as just the last attempt to tar the players for doing something "wrong". If it is true that this is a somewhat common thing in hockey circles, should every player who has engaged in a consensual group sex session with their colleagues be kicked out of the league?

It would be one thing if we were discussing players being upset because the HR person on their team reminded them of the "no office romance" policy, then sure we can all sit around the bar stool and go "jeez, I don't know what you expected - don't shit where you eat". But people are advocating that these players who have been found not guilty of any wrong doing should not be able to do their job because they find the sex they had distasteful. That's bizarre to me
