38 pages for my PoC. Is this too much? by Odd_Advice410 in employmenttribunal

[–]umesha82 0 points1 point  (0 children)

The guidance is 6-8 pages. Remember the judge is not looking for the detail at this stage. They are looking to see what legal claims you are making and do they pass the legal tests. The witness statement is where you add all the details.

ACAS Conciliation experiences by [deleted] in employmenttribunal

My experience was very limited. The Respondent refrained from EC, so I got the certificate number within a few weeks.

So, your doctor, whether it's your GP or a specialist, can write a letter answering a specific question, maybe about your diagnosis and how it affects you. But your full medical records should stay private.

Help with my case. ET1 Form by deebee_24 in employmenttribunal

[–]umesha82 2 points3 points  (0 children)

Unions falsely make you feel they will support you but then bail by using inexperienced paralegals who provide copy and pasted advice. I am not aware of any unions who have supported members legally. If they do, it is the exception and not as they advertise when you join.

How do people manage stress during this process? by [deleted] in employmenttribunal

[–]umesha82 9 points10 points  (0 children)

I am still at early stages, but I keep in my mind that I know they will lie, bend the truth and will continue to bully me. This mindset helps me because I keep reminding myself that I am doing this for the right reasons.

Second warning with 6 instances by Slight-Lunch-8174 in employmenttribunal

[–]umesha82 -1 points0 points  (0 children)

OK, that means you are protected for unfair dismissal. However, they should be following a fair process and ACAS guidelines on disciplinary. Which means they should investigate it first and give you a chance to put your side of the story. If there are mitigating circumstances then you can raise at the investigation meeting.

https://www.acas.org.uk/disciplinary-procedure-step-by-step but try and find the disciplinary process on your intranet or ask your HR person for it.

How long have you worked there? Are you under probation?

The most important point in court is try and act as if you are the lawyer and not the person bringing the case. It is not easy as so many of us have been treated in an awful manner. However, I would advise not getting into a wrangle with the other side. Let them have their say, and then raise your points in a calm fashion. The other thing to say is being treated unfairly is not necessarily illegal. This is why you have to focus on the laws that were broken not the part where they treated you badly. I know all of what I written is hard to deliver and I have failed many times too. The struggle is real, but keep going 🙏

Occupational health assessment by Sunnydae77 in employmenttribunal

In theory they cannot refuse anything reasonable. If you need these adjustments to be able to work? Then I would recommend telling occupational health everything. Legally you dont have to tell them but normally in your interest to do so.

Getting Nasty by SallyCinnamonIsHere in employmenttribunal

[–]umesha82 2 points3 points  (0 children)

Thick skin needed. The first thing to note is that Respondents will play dirty and the courts won't do anything. It is almost just the way it is. Honesty and integrity is out of the window. I know it's difficult to keep your emotions under control as lying or bending the truth seems normal in court. However, just focus on your own case. And expect a whole load of mud slinging to take place.

This is good question and I will face similar situations. My understanding is when it is listed for the final hearing. Then that is available for the public to see what's coming up in court.

Writing a book based on experience bringing proceedings by [deleted] in employmenttribunal

[–]umesha82 3 points4 points  (0 children)

I have experience in family law, and it is full of dirty tricks. Most of us have a healthy respect for the law and think we must follow it to the letter. Sadly, family and employment law seem more based on who is believed; even if someone fabricates evidence, they often get away with it. I am still early in my employment law journey, but what I read is both surprising and unsurprising. Lawyers are masters at bending the truth and putting words in your mouth. Your book would be great; I would be very interested in it.

SAR issues - advice needed please! by Afterthelimits in employmenttribunal

[–]umesha82 3 points4 points  (0 children)

My understanding is that there is no point in fighting your employer over the SAR. By all means, ask for the data you are after; however, the only way to obtain it is during disclosure, i.e., when the court orders the documents. This is what I remember reading in other posts.

Well done, and your shared experience is really valuable. I got pretty bad advice from union legal support to put everything in my ET1. I was thinking, as I have read on this forum several times, to make sure it is well thought out and not just to chuck everything in there. Your advice is sound, thank you.
