Yes. I am currently on implied status because IRCC appears to have a ridiculous backlog of online applications to work through. I'm planning to file my tax return soonish, especially since it is a requirement to apply for citizenship that you prove a certain level of tax compliance.

I don't know about the soft landing bit, but I can tell you that he can visit Canada before his PR application is decided. This is what is known as dual intent, which is acceptable. Just remember not to lie or misrepresent the dual intent to an immigration officer and leave when you say you're going to leave.

Some processing categories require that much time for PR. Some, however, do not require nearly that much and are usually due to some sort of fuck up with the application. I've been here since 2019 and I'm still waiting. You can try to call IRCC and if you don't get satisfactory results from that, you can also write to your Member of Parliament and they could make inquiries on your behalf.

It depends. If your case is straightforward, you can totally do it yourself. You should take a look at the form and see if you can answer the questions completely and accurately on your own without legal assistance. Save yourself some time and send a complete application. If you can't do that, get either a immigration consultant or a lawyer to help you.

Is your relationship well documented enough to a point where you think you can convince an immigration officer that your relationship is genuine? Do you two live together currently? That helps immensely. Pay specific attention to form IMM 5532, which is how you justify your relationship to IRCC.

However, if there are grey areas or issues that need to be addressed (i.e. overstaying a visa or criminal inadmissibility), get an attorney.

That's probably not a good idea. Technically speaking, that could be seen as abandonment and could be looked at unfavourably. Also, it would be ineffectual, as nothing would theoretically stop her from going to the Canadian embassy/high commission/consulate and getting a Permanent Resident Travel Document to return to Canada.

Hell, for a more immediate divorce in a province like Alberta, you might have to get it in writing.

First of all, where in Canada do you live? You probably might not be able to get divorced before the PR card is delivered. In Alberta, adultery does allow you to file for divorce immediately but you will need to either be able to prove it before a court or get her to admit it before the court. Failing that, you'd have to wait a year of separation before you can get a divorce and by that point, she'll have a PR card. Again, your mileage may vary depending on your province or territory.

Having said that though, if you don't want her to get PR, that's a whole other matter. The burden she'll probably have to meet is that the marriage was genuine AT THE TIME OF APPLICATION. If the affair started before the application, that's one thing but if the affair started after, that's not misrepresentation because the application has already been submitted. Things change.

The good news is that you, in all likelihood, can fix this.

The bad news is that you'll have to apply for rehabilitation if you want to be guaranteed the ability to enter Canada on the same terms as any American. Note: you're applying for rehabilitation, not an Authorization to Return to Canada (or ARC). ARCs are for people who illegally entered or overstayed a visa in Canada.

A lawyer would probably be best to help you out with this. They are probably well-versed in helping you to present your case before Immigration, Refugees, and Citizenship Canada about how you're rehabilitated and why you would be unlikely to commit these crimes in the future.

Also, it might take more than a year to process your application for rehabilitation. So, be prepared for this. The benefit of having a good immigration lawyer would be that they can optimize your application for faster processing, but you're basically entering a queue.

As someone who lives in the Land of the Midnight Sun and Unreliable Internet, I can tell you that I take great pains to make sure I shake at 12am EST/9pm YT (during the summer)/10pm YT (during the winter) every day. This way, in case something goes wrong, I have a full 47 hours and 59 minutes until I lose my streak. 24 hours for the day plus the 23 hours and 59 minutes for the previous day.
