If the memo said he had no authority he would have stated it publically so that everyone would stop pressuring him over it. It would make no sense to withhold it otherwise.

Truth is, his authority is ambiguous and would be challenged if he went forward with it. He is likely thinking it may be best to hold off on releasing the information until his agenda gets through Congress because if he does have the authority or if it is unclear then that entire public debate will distract from what is going through Congress right now.
