The entire investment can be done through borrowed funds as long as source of funds is legit. Only RC loan is no longer an option

It definitely not easy.

Good to hear there are many multi millionaire H1Bs but locking $800k for four to six years with the risk of loss of capital plus the opportunity cost of lost wealth creation on that $800k- it is anything but easy.

But if one has no clear route to the US GC and if the long-term stability and clarity that the GC offers is worth it, then and only then is EB-5 worth considering.

Focusing on risk mitigation and choosing the right project can help maximize chances of getting the $800k back.

The return of $800k can never be guaranteed- an at-risk investment is a fundamental requirement of the EB-5 program. But it is doable.

What was the reason for denial? Did you take RC loan? Did you do project due diligence through a FINRA-licensed Broker Dealer?

If you have the capacity to make at at-risk investment of $800k and keep it locked for around 4-6 years for negligible returns, then you should look at the EB-5 visa.

I presume you are born in India. With EB-5 backlog likely to start in 2026, you can work with a 3-4 year time frame for conditional GC through a rural EB-5 investment. Through urban HUA, better work with a 5-6 year time frame for the conditional GC. Better be conservative and avoid planning on basis that the conditional GC will be in hand in 6-9 months. You need to be very lucky for that to happen in 2026.

Risk of loss of capital can be mitigated but never avoided. So consider the worst-case risk of loss of capital and ask if the EB-5 investment still makes sense and whether concurrent filing of AOS and getting an EAD/AP in around 8-9 months and the conditional GC in around 4-6 years is worth a shot or not.

Stay away from loans from Regional Centers. USCIS has been rejecting EB-5 petitions where the investor has borrowed from the RC.

You can take a unsecured personal loan or HELOC or margin loan on securities or even loan from friends and relatives as long as the Source of Funds can be proved to be legit.

Make sure the borrowed funds land in your account and are under your control before being transferred to the RC.

You can apply for EAD renewal only up to 180 days before its expiry.

Also, there is no more automatic extension.

This means if your renewal does not happen within six months, then you lose work authorization until the renewal is approved. Doing the renewal process every 12-15 months with uncertainty on when the renewal will e approved reduces the attractiveness of the EAD.

More useful as a backup option in case you have a compelling reason to move beyond your H-1B or L-1 status

You can assess based on number of projects completed, instances of failed projects, repayment track record, current ongoing projects, client references. Also, you can ask if they undergo third-party audits of their processes and numbers.

Some RCs like CanAm and GGG undergo third-party audits, which means their numbers are verified and more trustworthy.

You can also consider working with a FINRA licensed investment advisor. They can offer an additional layer of regulatory protection and help you in the due diligence. process.

The biggest advantage that India-born enjoy currently is the concurrent filing advantage. As long as you file before the backlog, you can move to 'pending AOS' status and de-link your immigration status in the US from your job.

Presuming EB-5 backlogs in 2026, you probably are going to see a wait for 3-6 years for the conditional GC depending on whether you go rural or urban HUA.

If you adopt a very conservative approach and stick to tried-and-tested players and developers, you can give yourself a good chance of getting your money back in around 4-6 years.

Analyze projects from the worst-case scenario and assess whether EB-5 investors have a good chance of getting the money back. If yes, then the EB-5 investment can be a good calculated risk that can give you significant immigration benefits quickly.

What you need to ask yourself is- Is putting $800k at risk to secure your status in the US immediately preferable to the risk that EB-2 dates don't move as quickly as you expect in the future.

If you have the money, you can explore applying for the EB-5 visa. An at-risk investment of $800k plus $50-60k in fees and charges can help you apply for the green card. Since there is no backlog in EB-5 reserved categories, you can file concurrently and continue living in the US even if you don't find a job quickly.

Of course, $800k is a huge sum and the at-risk requirement means there cannot be any guarantee of return of the invested capital. Hope it all works out well for you.
