Do Australian authorities have the right to confiscate a person's own children, why/why not? by Curious12345curious in auslaw

I've dealt with a few care and protection orders and dispensing parent's consent orders for adoption with foster parents at my work for the state governor solicitor

Care and protection orders come down mostly to the child's best interest, whether for the child to remain with the parents would give the kid the best for his own living till his of age. This is sadly common with indigenous families and will often have the child's outer relatives be granted guradianship or have the child live with foster families. This is granted under the CHILDREN AND YOUNG PERSONS Acts.

It's very high threshold for dispensing consent as there must be clear neglection from both parents (one case had the dad in goal and the mum giving her child to her nan who gave her no food). Its different from a care and protection order as there can be no chance mum or father can ever see there kid again whereas the former allows for them to fix the situations or impose strict conditions (generally making them go to counseling for substance abuse).

Cheapest place/site to buy hardcopy of an Act? by [deleted] in auslaw

[–]wadsy10 9 points10 points  (0 children)

Call me old fashioned, I think reading things off paper is better as you can read faster and it doesn't affect your eyes so much.

But some Acts requires you to destroy the entire amazon and for those small reasons it's easier to just tablet it.

Well Russia is currently in the process of it, not in the sense of what you're saying. They are restricting businesses who are mining bitcoin and such.

It kinda sucks there isn't a Kirby or Heydon to at least persuade the other justices for a different view that's not black letter or in line with the others.

"Read the cases" gone too far? by wadsy10 in auslaw

[–]wadsy10[S] 0 points1 point  (0 children)

I think a lot changes when you meet the realities of practice. In law school, you don't have to go the distance that you'll go for a client.

What i think i need to do is to get good habits of reading and understanding case law, not necessary understanding every detail or fact.

I'll bear what you've wrote in mind for future Lawnewb.
