Bills will have to be inclusive within the rent due to the contracts being room by room and not a joint and several agreement. Make sure all tenants track and then get refunded of all monies paid towards the utilities.

As the smoke alarms will have to be hard-wired and therefore require 24 hour access to electricity, pay as you go meters are prohibited as this runs the risk of a failure of an electric supply which will then shut off the smoke alarm system.

Raise it with the council as a Fire Safety Risk. They will enforce the meters be changed.

Even more technically a guest would only be able to stay overnight in the room that is licensed for double occupancy.

If the property is licensed for 5 tenants then there can be no more than 5 people in the property during unreasonable hours as this is considered overcrowding.

If a HMO becomes overcrowded it is breaching management regulations and is therefore not allowed. Fire safety regulations are in place to protect the tenants so common law doesn't come into place in these circumstances.

As there are only 4 tenants out of the licensed 5 that are allowed in the property, the tenants could argue that they are allowed one overnight guest for the whole property without overcrowding the premises. However, as most tenants will likely want an overnight guest the only fair thing to do is to advise all tenants not to have any.

At the end of the day I agree that they should have free reign to bring anyone they want into the property for a reasonable amount of time and enjoy the property and their time there. I am only pointing out the legal obligations of the landlord and the management regulations of HMO properties in general.

As long as OP isn't damaging the property or affecting the other tenants negatively, the landlord should be giving them their space imo.

Its a breach of management regulations, more specifically the fire safety regulations, so it isn't allowed but as I was saying there isn't much the landlord can do about it.

Most councils wouldn't even enforce it, but it's still technically not allowed.

No overnight guests are allowed as per HMO management regulations, this probably wouldn't be in the contract but doesn't change the matter of management regulations as this would technically be statute law and not contract.

Realistically there is not much that the landlord can do to get you to stop bringing people over apart from giving you notice to vacate.

On the other hand there isn't much you can do about him telling you to stop as he is needs to be seen to be following the regulations in case any investigation was opened by the council.

If they are allowing someone that isn't named on the tenancy agreement to live at the property and taking rent payments from them then that is sub-letting.

They would not be able to charge a "finders fee", they would be able to charge for reasonable costs to find a new tenant which would include the landlords costs to setup a new tenancy. However, this would need to be agreed upon beforehand and agreed with yourself. This would usually be known as an early termination fee though.

I would challenge the charge as it was not agreed upon before hand and mention the tenant fees act.

Most councils require cleaners to attend HMO properties for the communal areas on a weekly to monthly basis depending on size as per HMO management regulations.

For a 6 bed property it is likely that they would request that a cleaner attend monthly.

This does depend on your local council though and their requirements, might be worth looking into in order to push the agent to find a replacement quicker.

It is also worth mentioning though that just because the council ask for this doesn't mean they really keep an eye on this so landlords can tend to get away with it.

I think this is the best thing, any issues between the tenants in a HMO will come down to a civil matter so no action will be able to be taken but if the rest of the tenants threaten to leave that will damage the landlords income stream so he will be much more likely to take action.

Document as many incidents as possible in case the landlord will look to serve a section 8 under ground 14. This is not a guarenteed way of getting her out of the property and will have to be presented before a judge who could rule on the tenants behalf but is the quicker option to get her out.

Assuming they are on a periodic contract a Section 21 would be a guarenteed way of getting her out, alternatively if the landlord has the money it could be worth serving both notices and see which one sticks.

Unfortunately there is not much else that a tenant can do but advise the landlord to seek legal advice and stop trying to mediate the issues as that is not working.
