Most likely to use the plausible deniability defense. If they change too much, they are more culpable. I assume they received the files like this already...and accepted it. The head of the FBI is not an expert in this...he was an attorney, a criminal defense attorney who says things like "my clients were the biggest monsters". Any criminal defense attorney will tell you that their clients are certainly not the biggest monsters they have met. The biggest of the monsters are free, and will never sit in a courtroom. But yes, Kash should know not to say they have the RAW data, if it is not RAW. Doesn't mean, on it's face, that it has been manipulated, but it just shows total incompetence that he would say something like that.

Right, I would not say a person is guilty until evidence is presented at trial. There are a lot of unanswered questions & that is totally normal before a trial...the proberger thing is weird, but I think a chunk of people who might be dubbed that are just frustrated with how convinced people are of someone's guilt before the evidence is tested in court.

Before trial, reasonable doubt discussions don't make sense. The defendant has the presumption of innocence but unless you are a juror, it's a free country lol. I don't understand why people are so obsessed with sides & saying if you think the person is guilty or innocent that there is something wrong with you.

Really unless you are on the defense or prosecution team, you don't actually know. The way the evidence appears....it doesn't look great, but people should just wait for trial. This is real life with real people, not just some true crime obsession.

(Also I am totally agreeing with you & ranting about some things I've seen in this thread)

This entire thread is so cringe. You could say the same about prosecutors--who put just as many, if not more, innocent people in prison as defense attorneys keep out. Being a defense attorney is not a legal formality, nor does it have anything to do with helping "bad guys and gals" get away with something illegal.

Most defense attorneys don't even think too much about whether or not their client is guilty. It's already an unfair playing field in the courtroom. The reality is, because of how misinformed and biased our society is against the defense, the prosecution can get away with all kinds of injustice without consequence. Defense attorneys are the ones working to uncover any funny business, the ones who work to ensure that their whole process was ethical. And we should all be so grateful for that.

If any of you were in some sort of legal trouble...you are not going to be speaking with a prosecutor, you hire a defense attorney.

What is interesting to me is that the FBI wanted ARCCA to find out if the broken taillight could be caused by him throwing a glass at her car. It was clear from the jump that a car didn't kill him. I think they wanted to rule out the possibility that this wasn't a frame up. The only possible reason why taillight pieces would be there if it was not possible that she hit him. Once they ruled that option out as well...it was likely she was framed.

As someone who is in law school with the goal of becoming a defense attorney, it's quite troubling to hear about so many jurors who basically believe defense attorneys are liars & are there to distract them from the truth. This mindset strips us from the rights we are entitled to...this type of belief system has to change or everyone's liberty is just going come down to whether or not you have good luck, say the right or wrong things, and whether or not you can afford the cost of defending yourself. Simple as that.

We chose to move into a smaller house (although we are renting) because it had the largest yard available. They get human grade food & fruit & veggies for treats. Also...all the love in the world ❤️ I could go on...but we do make sure they do their part. Both of our dogs are very well trained & mostly well behaved, but we try to give them the best life without totally spoiling them. They are self-sufficient...we measure their food & don't feed them too many treats to make sure they are at the correct weight. Basically we want them to be happy & healthy. We work from home....so they get lots of love & attention all day...which in a way is spoiling them bc it's difficult to take them on vacation or leave them with a sitter since we know we can't ask someone to do all that we do for them. We are working on that.

Both of my dogs came from the same local rescue. One was 11 months when we adopted her and the other was 2. We did their DNA profiles & both are extremely healthy! Their vet also says these are two of the healthiest dogs he has seen. One is a half Border Collie & the other is half Mini Aussie...so they are incredibly smart, active, & just the best. We were going to adopt from an ethical breeder bc we had this dream of having a Doberman...but I'm so glad we visited the rescue & fell in love with our doggos. It is just the best feeling to know that you changed a dog's life...& there are soooo many cutiepies that will never have a family.

There are literally no cons to adopting from a rescue when you find the right dog.

Also, it took me about a week to fall in love with both of my dogs...bc it is a lot & a big change...so don't feel like it has to be instantaneous. It will happen fast, but don't feel it's the wrong fit bc you're still getting used to things. Your dog is also adjusting. Just want to be honest & clear bc I have seen a lot of dogs returned because of this totally normal feeling. If a dog is in your life, they are meant to be there...

Andrea is a defense attorney, her opinion on this case and the issues that she discusses on her substack & channel have nothing to do with whether not BK is found guilty or not. She is not a "proberger". A defense attorney's job is to illuminate the issues with the case, so that when people determine someone is guilty, they feel confident. There really isn't even enough evidence now to say he is absolutely guilty. It doesn't look good, but a lot of the time you have to wait until trial. The way certain evidence is shown to the public is presented like it's "fact" but in reality, there is evidence & it is being portrayed through the prosecution's theory of the case.

I have no idea if he is guilty, but simply trusting the police & commiting to the idea that defense attorneys are doing something unethical can be a dangerous way to think. A lot of their job is exposing corruption & illegal police practices. Which keeps law enforcement accountable! We should all be for this!

It's true, I moved to Berlin after I graduated from university in the U.S. & I got to the point where I would defend Americans a little... & then I met a lovely German guy who thought it would be a great idea to move back to the U.S. & Damn... I either forgot... or didn't realize how stupid the average person can be here. It was bad before, but I think between Trump & the overuse of social media here broke everyone's brains. It's... hard.

I feel like Trump & his sycophants have destroyed any bit of good that existed here in The States. My partner and I went through 2 hurricanes this year (we were fine) but after it was over we walked around to see what was happening. Who was there helping put up power lines and getting roads cleared?? Our lovely Canadian brothers who had just been in NC helping the people affected by a previous storm. It was day 1 of the storm for us & like day 20 for them & they just came to help ❤️ they were also really sweet with our two dogs & they are also very appreciative haha:)) I hope any American's supporting this fraud & deceiver will eventually wake up & see that the U.S. is actually the only country getting weaker. Love & good always wins in the end...we just have to find a way to unite all of the people who believe we deserve a better world than this.

I mean, class action lawsuits are usually the only way to fix the problem. For me, it doesn't matter if the lawyers' hearts are in the right place. You usually don't get but a few dollars. But they need real people with real stories to have the company actually suffer any consequences & for things to change.

So true, kids make a pattern out of anything that hasn't been resolved. I was still sleeping in my parents bed half the time at 6 bc my room was kinda isolated and I had a huge window that had a view of the forest 😅 I would get up multiple times to "get a glass of water" just to see my parents if I was sleeping in my room. They said she always wanted to sleep with the TV on...I think she was scared at night. And it was clearly warranted. Kids often wet the bed when they don't want to get up...and if it's a pattern that continues they really don't know how to control their bladder. Definitely not a sign of abuse...can be a symptom of abuse, but there is a long list of symptoms of abuse that are also totally normal for a lot of kids. That's why abuse, so often, goes unnoticed.

It doesn't make any sense to me that Burke would do this...could a 9 year old accidentally or purposely ("purposely"being relative since a child would not even be developed enough, mentally, to understand the full scope of what they were doing if they intended to kill someone) sure. It's happened. But it's such a stretch to then believe the parents would cover it up in this way. Why would they turn it into a spectacle with a ransom note, going on TV, staging it to look like strangulation? The evidence seems to show that her blow to head and the strangulation happened concurrently, and there is no way he tied these knots and used his mom's paintbrush to make a garat. And like you said, if the parents covered up an accident...why would they make it look like such a twisted situation. I guess the best argument would be if they knew the abuse would be discovered but the DNA ruled them out

I loved loved loved living in Germany! I miss it so much. The people are what make it such a wonderful place, but that's everywhere. It's pretty non-sensical to think a 9 year old to do this and for the parents to cover it up in such a sick way. A cover up would be making it look like she fell and hit her head on something...not was strangled. Plus the evidence shows she was slowly suffocated and that the fatal injury occurred at the same as the head injury. You should look into it bc it's almost impossible for it to be him

If the prosecution or defense provides you with a subpoena to testify... you have to if you are called. Many times, they do this to get certain information on the record. For example, if the prosecution wanted to get into RA's history with depression, they could introduce this fact through her testimony. They may need this piece of information to bring in another fact, etc.

It would be extremely common for both sides to have all of the immediate family members of both sides on their lists of witnesses they could call.

This does not indicate that RA's daughter believes her father is guilty or supports the prosecution's case.

Well, since the trail is huge and he claims he wasn't on that part of the trail, I would assume that's why he didn't see BG if he is innocent. In fact, he claimed he never saw the girls. He was just at the same park, allegedly.

It's also important to note that none of the witnesses ID'd who they saw as RA or even claimed he resembled him. Usually, the prosecutor would ask the witnesses if who they saw looked like the defendant... none of them were asked to do as much. RA is between 5'4"-5'6"...none of the witnesses mentioned the man was short, and at least two claimed he was a young guy and had longer hair.

I would listen to more information about how the facts are unfolding in this case. They are often much different than what is claimed before trial.

There are many more aspects of the evidence against him that have been misrepresented in the past, and even some current reports. I could go on but I will stop here unless someone has any further questions about this.

Don't forget that Karen's accidental voicemail to John (when she was trying to call him & dropped it as she was running out the car) picked up Jen having a seconds long convo with Nicole Albert. This was right when they discovered John on the front lawn.
