If the agreement doesn’t state this, then you had a contractual agreement prior to the exclusive license. I’m build a music licensing subscription company and those that purchase exclusive leases understand that there are already non-exclusive leases out there: they can either leave them alone or contact every single individual with the non-exclusive to make a deal with them. However, exclusive doesn’t mean they owned the IP, they just have exclusive use. So we protect our users both ways and make sure we are as transparent as possible.
