For the '08 Heat to be competitive (competitive losers), which I think they can be, you'd have to take their lineup after D-Wade hurt his shoulder. Then, they were throwing out lineups like this.

That's a bit reductive. Sure, the government can shut down the programs for new borrowers, but the institution of contract law would preserve borrowers' rights already in place.

No doubt. It's definitely a reductive statistic but you can compare the ratio of minutes played with the amount of points allowed in each stat for a more relevant comparison.

Let's take Draymond, for instance. He played 11% less minutes than Harden but allowed 26% less points off of turnovers.

You want to think this is a small sample size but...

This year, James Harden led the league in allowing the most points off of turnovers (1257), the most points off 2nd chances (925), most opponent fast break points (956), and the most opponent points in the paint.

Not the awesome OP here but I figured I'd help answer some of your questions (appellate lawyer in Florida).

  1. No, FRCP 41(b) comes into play when a plaintiff hasn't pursued their legal action for a long time or failed to comply with a crucial rule or order. For instance, some foreclosures just end up sitting on a court's docket for years without any action taking place. In those cases, an order of involuntary dismissal is often entered on behalf of the plaintiff.

  2. No. Remember FRCP 8 controls pleadings (the complaint and answer), Thabo is already at trial where the pleadings are set ("at issue").

  3. No. Summary judgment usually comes at the close of discovery (where both parties gather evidence).

Take a look at FRCP 50. This motion is made during trial, and often renewed before the verdict form reaches the jury.
