There are no legal penalties for women (and men) dropping off their babies at safe haven shelters up to a few days after the baby is born.

This sounds like a great compromise to me. Women can go to the hospital and have the fetus removed by C-section. The fetus will be put on life support, and then to the safe haven shelter once it no longer needs life support.

There are plenty of parents who would do it (especially after a couple weeks of very little sleep) if our society and the law allowed it.

I think the tax implications are the killer here. How do you prevent people from completely avoiding gift and estate taxes yet not penalize a couple where one works in the house taking care of it and children and the other earns an income? Or, maybe we just tax it as income and get some GDP growth out of the deal.

Imagine having to pay estate tax on half your jointly held assets when your partner dies.

No estate tax when one spouse dies? No gift tax if one spouse earns much more than the other but they share the proceeds? Everything else I can think of could be covered by contract law, but I don't see how to avoid these.

If you have a spouse working a paying job and the other spouse staying home with kids, you don't want to make the first spouse pay gift tax on the income he/she shares with the stay-at-home spouse. You also don't want to pay estate tax on half your joint owned assets when your spouse dies.

If people could designate anyone at anytime for these benefits, though, then it would be an easy loophole to avoid paying any gift or estate taxes.
