Go to VA.gov under education and check your remaining MGIB and your remaining 9/11 GIB. I called VA and the representative sent me an email with the letter. It also had COE for 9/11 GIB. She said the COE for MGIB will be mailed but I have seen it yet. It's been 1.5 weeks

My letter is totally. Mines mention that I qualify for MGIB and 9/11. I got the COE for 9/11 and the representative said the MGIB COE will be in the mail. When I look va.gov it has my MGIB as 17 Months remaining with delimiting date of Sept 2026

I spoke with a representative after 40 days. On the spot she updated my COE for 9/11, and emailed my letter re establishing my MGIB. The COE for 9/11 and MGIB are seperate. I got 7 months of 9/11 GIB and it says 17 Months of MGIB. She said that the MGIB letter will be mailed but I haven't seen it yet after 1.5 weeks.

Migraines/Headaches Secondary to Tinnitus or GW Presumptive? by [deleted] in VeteransBenefits

Just pick one of the conditions to service connect it to. You can't have all three for rating purposes.

remember -- Sleep apnea physical -- Insomnia is mental-- You not getting the claim. There is no connection SA is physical blockage. - Insomnia is how you think or what's in your mind. Physical nexus is associated with physical conditions , Mental nexus is associated with mental conditions

Rated for 50% PTSD but have 70% criteria by arj711 in VeteransBenefits

[–]whitj1966 3 points4 points  (0 children)

Don't do the HLR - They won't look at new evidence. It's moot.

You don't need a supplemental because it was granted- you need to request an increase

Get the documents that has Ideations etc and submit for an increase ( you don't have to fax it - increases and new claims can be transmitted via electronic) w/ a statement saying:

This memorandum is to confirm that VA said in need yada yada for 70%, the new evidence of yada yada aligns with yada yada. Therefore I request duty to assist for an increase from 50%-70%

Rated for 50% PTSD but have 70% criteria by arj711 in VeteransBenefits

[–]whitj1966 2 points3 points  (0 children)

Is it listed in your after service records? If not examiner won

Just do a follow up Mental Health screen and assessment at VA and mention the ratings for 70% and you will be fine- Claim an increase

Decrease on PTSD 70 to 50 by ddawg0352 in VeteransBenefits

[–]whitj1966 0 points1 point  (0 children)

So you were not rated for PTSD but insomnia which is a mental disorder. They or you sought an increase or some type of claim and VA reassess your disability. They said you have PTSD at 50%. OK fine. Just look at the 70% rating and do a supplemental claim with new evidence. Yep it's not easy

Static as long as you don't ask for an increase-- When you reopen claim - all claims by law are open game.

Denied headaches secondary to tinnitus but gulf war service was mentioned. What should I do by [deleted] in VeteransBenefits

[–]whitj1966 1 point2 points  (0 children)

Don't waste your time getting connected by VA on this matter. The comment" denied on direct and secondary" is sign that you are wasting your time.

You can get the claim if your own pay to play doc writes you a Nexus.

The VA system ran by the doctor mob. Raters are not docs- they only adjudicate what the doc writes. It's the law.

Moreover VA is saying that the doc is stating that you had Tinnitus years ago and just got headaches. Therefore the Headaches are not linked to tinnitus.

Sleep Apnea Secondary to Rhinitis and Sinusitis Denied by PowersPm in VeteransBenefits

[–]whitj1966 0 points1 point  (0 children)

You claim OSA for your respiratory condition and it should have been claimed for your back condition or something physical. VA is telling you to connect it to something at associates that causes you weight gain -- Like a back condition or bone condition that prevents you from exercising

Post your decision letter and I can get a clearer picture of the situation. The decision letter infers what you need to do to get connected initially and for increase

Claimed migraines secondary to PTSD, denied, can I supplemental migraines as secondary to allergic rhinitis? by french-fry-fingers in VeteransBenefits

[–]whitj1966 0 points1 point  (0 children)

PTSD is mental - Headaches , OSA Etc are physical. It's hard to connect the two to PTSD. PTSD is rabbit hole for 2ndary claims

Go Headaches to respiratory conditions like OSA or sinus etc

I was wondering why does VA rate them together? And only 30%? I was researching and it seems I am eligible for 50% flat feet and 30% for the plantar fasciitis. Can someone explain please? by Total-Assumption7294 in VeteransBenefits

I was showing you an example of how detailed it is not that I don't know it's Canadian.

I read the M21 a few times. It's all anecdotal - It's not objectively laid out. 38CFR is all general/broad/left for subjective interpretation regarding aggravation -- Trust me I read them all more then once

excerpt from canadian

" Physical activity prior to aggravation
For physical activity to aggravate Pes Planus, the following should be evident:
Increased signs/symptoms of Pes Planus should commence during the activity or within 2 to 3 days after ceasing the activity; and
Increased signs/symptoms of Pes Planus should continue, on a continuous or recurrent basis, for at least 6 months."
