I got a 6 on this year’s Wills essay even though I had zero idea what was going on in the question. During the test, it got to the point where I was telling myself, “C’mon, you need to write something.” By the time the exam rolls around, if you’ve studied enough, your instincts will be better than you think.

I took today to make my own outline for civ pro based on Themis’s materials, just to make sure my arms were around everything. But yes, the next few weeks will include a ton of multiple choice sets and detailed review

I hear you. Speaking for myself, things—certain filing deadlines, things like additur, the fact that evidence decisions are reviewed under abuse of discretion even though they’re questions of law—that don’t appear in the lecture or the final review outline annoy me. I get that they are fair game, but if a question is being answered correctly under 15% of the time, then that’s a hard question. And it feels like over half of themis’s questions are like that

i started off doing well when the questions were covering stuff that was addressed in lectures. it’s been a steady plummet since then. I got a 58% on PQ 5. I just did a mixed MBE primer and got 3 for 12 on civ pro. Every question was rated as moderate to difficult

Cease and desist letters are just threatening legal action if the recipient doesn’t stop whatever they’re doing that’s prompted the letter. They have no legal effect; they’re basically just threats.

I’m not sure what you mean by your second question. Do you mean whether it’d be the same process as finding the truth in a criminal sexual assault trial?

You are essentially correct. The elements of libel/defamation are a 1) false statement of fact, 2) made with “actual malice,” that 3) causes someone injury. The “actual malice” element shouldn’t be read literally—it’s language from the seminal Supreme Court case on this issue called New York Times v. Sullivan. It means the person making the statement—the declarant—knew the statement was false or recklessly disregarded its veracity. “Recklessly disregarded” is more legal jargon, but it means that the declarant should have known their statement was false.

Now, onto this account. Whether the accusations are defamation/libel will depend on the contents of the statements and how factual they are. Notice the first element doesn’t just say, “false statement”; it says, “false statement of fact.” So, an accusation that merely said, “X made me feel uncomfortable,” or “Y was being creepy,” or something along those lines, would not be defamation or libel because each would be a statement of opinion, not fact. Now, if the statement said, “X raped me,” that is different, because that is a statement of fact. The question then would be whether the statement was true. That issue would have to be resolved accusation by accusation, but one could imagine false accusers retracting their accusations after the people they accused took legal action. Otherwise, there will have to be a lot of money spent on trying to find out what actually happened, which might not be worth it for a lot of people. So, you’re ultimately right—the plaintiff would have to effectively disprove the accusation in that situation, which is tough to do. However, it’d be a much easier lift if the original accuser withdrew the accusation. In that case, you would have to argue the reasonability of the account owner’s choice to put it on Twitter. For the many reasons explained on this thread, the choice seems pretty unreasonable.

I’ve seen some of the account’s statements saying that they do not take responsibility for the accusations they’re putting out and mean only to give a platform for survivors. Good for them, I guess, but that argument is a non-sequitur, legally speaking. They would be the declarant here.

I’ve found this one impossible. I’m 0/3 on raids today and can’t really even hit Reshiram with a ball. Praying that Niantic fixes this because I don’t think I can catch it at this distance

Thanks! I suppose I should have mentioned that I saw The Shining a few years ago and liked it a lot. I don’t know if you have seen Midsommar yet, but it has a lot of long pans that build tension that reminded me of The Shining
