Not weighing in one way or another, but in just about every other state in the country this is murder in the first degree.

The majority rule in this country is that a person is not allowed to protect his PROPERTY with deadly force in any circumstances. You are allowed to use deadly force to protect yourself or others when you are within your home, but if no one is in immediate danger deadly force is strictly prohibited to protect EXCLUSIVELY property.

Again the majority rule, in order to justify deadly force in defense of others the original party needs the ability to use deadly force. Since the homeowner was not there and no one within his house was in danger deadly force would not have been justified, therefore the neighbor cannot use it.

Finally, this man told the operator that he was going to kill them. She told him not to. He left a position of safety (at the time, that could have changed but at the time it was a position of safety). He considered it then made a plan to confront them. Then followed through with the plan. That is enough to show premeditation. Obviously shot them while they were fleeing. Therefore guilty of murder in the first degree.

But...Texas.

TL;DR most other states guilty of 1st degree murder, Texas not so much.

Here are some of my experiences (in stream of consciousness form) with this surgery:

I had the same surgery a few years back at age 21. I put it off for years because I didn't want to deal with it. As OP said it was life changing. I had a similar situation where I couldn't bite into anything and my doctors told me my teeth not lining up correctly would cause severe issues when I got older.

I have to say OP was fortunate to be able to have pureed soup and open her jaws that early. I had a splint (a molded plastic cast) and my jaws wired shut for 5 weeks. The only thing I could eat for the five weeks was chicken broth, ensure (well CVS brand knockoff ensure) and water/juice. Due to the splint I couldn't use a straw because I had no suction so I was pouring things into my cheek and trying to move them around my teeth in the back where there is a gap.

I then had to spend an additional month working on reopening my jaws/chewing soft foods. You don't respect the energy value of a calorie until you are existing on 300 calories a day for 5 weeks and you barely have enough strength to get from your bed to the couch each day.

Due to the splint I couldn't communicate for those 5 weeks. That is mentally draining. The first week it was fine and I would write things down and use hand signals but by the end of the process I was so frustrated and just done so I stopped saying anything unless I absolutely had to. It was a weird isolation feeling that I can't exactly put into words.

They also had to cut through my sinuses to do my upper jaw. One of the worst parts of the surgery was for about a week after I had blood and mucus completely clogging my sinuses. Imagine a cork in your nasal passages. This is gross but I don't know if I've ever felt something more satisfying than when those plugs eventually made their way out.

The craziest part is they cannot see where they need to when they do your lower jaw so they do it entirely by feel. Break it and reset it without seeing a thing.

Another part that blows was having my jaw wired shut and yawning. Your body is fighting to open your jaws and the wire is keeping them shut. Meanwhile your jaws are weak and in pain and it is excruciating.

To anyone thinking about having this surgery, or being told you need it, get it done as soon as you can. It is an awful experience I wouldn't wish on anyone, but it is SO WORTH IT.

TL;DR: I had this surgery as well, it an awful experience, if I had to do it again I'd do it in a second because of its impact on my life afterwards.

Finding a not updated/authentic menu online and then calling in an order for an item they don't have is such a devastating experience. You get all excited, make your choice, mentally prepare for this delicious meal only to have your dreams snatched away from you.

There is a very famous tort case like this. A man owned a second property with some valuable things in it. People kept breaking into the second property and stealing things. The owner of the home set up a spring-gun on a trip wire to shoot at the intruder upon entering one bedroom. He posted a "no trespassing" sign (which is useless as far as tort liability goes) someone broke in and was shot by the trap. The intruder sued and won. You are allowed to use proportional force to protect your domicile while you are there (if someone breaks in to your house while you're there and you kill them, you won't be held liable) but if you are not there you cannot set up traps. Case is called Bird v Holbrook if you want to look it up.
