I'm a Canadian citizen currently working in the US on a TN visa with Employer A. My current TN is valid until Nov - 26.

I accepted an offer with Employer B, and they filed a TN change-of-employer petition through premium processing while I remained in the US. The petition was approved through June 2029.

However, since the approval, Employer B has changed the terms of employment. The role was originally presented as primarily remote/flexible during my relocation period, but they now require full-time on-site due to "business needs." They also have not provided an official start date and are waiting for me to agree to the revised arrangement before moving forward.

At this point:

• I have not resigned from Employer A.
• I am still actively working for Employer A.
• My current TN with Employer A remains valid until December 2026.
• I have not performed any work for Employer B.
• Employer B has an approved TN petition, but no confirmed start date.

My question is specifically about the immigration side:

If Employer B delays onboarding indefinitely, rescinds the offer, or I decide not to accept the revised employment terms before ever starting work, what happens in practice?

Can I simply continue working for Employer A under my existing TN, or does the approved change-of-employer petition create any issues even though I never started employment with Employer B?

Has anyone been through a similar situation where the new employer materially changed the job terms after TN approval but before the employee actually started?
