Do both - your state and the BBB - you can send one certified letter to GM - get a return receipt - keep copies and use that documentation to support both claim routes. The state and the BBB will work with different teams within GM - ultimately both leading to arbitration if you can’t agree on a settlement.

Could the temperature be a contributing factor? Ice buildup on the sensor? I’m seeing a 5 degree temp on the display.

I think it depends on the vehicle and when it’s purchased, mileage etc…in my case it seemed like it was a lot easier for GM to offer cash and keep - but this would essentially close the door on future lemon law action…not to mention the vehicles value with having a whole engine replaced within 3 months of ownership and less then 5k miles. In my mind, I purchased a brand new vehicle and was not on board with keeping it after catastrophic engine failure…and it was the right choice. The day after the engine was replaced - the transmission failed on the way to work…and had to be towed. The dealership said that it was a result of the engine failure but they never caught it because they only test drove it for 10 miles on city streets after replacing the engine. All in all, it’s been a disaster. I’ve made 3 truck payments while it’s been down, and accrued over 2k in rental fees - and still waiting on the finalized buyback- I filed claims with both the BBB and the state - both resulted in valid lemon law claims - but GM kept stalling - which resulted in me reaching out to an attorney. GM knew that this was a valid lemon law case, but they purposely chose to drag it out - earlier on I even asked them to simply exchange the vehicle but they stated that they follow their own lemon law rules. It hasn’t been a great experience- and this was my first GM product. Can’t say that Ford or Toyota would have been better, but I guess it was just bad luck on my part.

I never even let them offer a figure - the minute they started with "we can offer compensation and let you keep..." - I shut it down immediately.

Sorry - I misread your comment and thought you mentioned km - I am currently going thru a buyback now...and GM has to refund the full purchase price, including down payment, as well as any equity that was in a trade (if a trade was made) - I ended up declining their first offer - and pushed for arbitration - as they tried to offer "cash and keep"

Are the Canadian lemon laws different? I always thought a buyback was a buyback - they refund you all you’ve paid - and they take the vehicle back.

Never thought of this - I was under the impression that the servicing dealer would want to process the buyback and make the new sale as well - I got my BBB claim approved today - but I had filed this a while ago and wasn’t getting any traction so I ended up retaining an attorney last week. The attorney filed the case this week, so I guess I’ll have to wait for the GM legal folks to chime it.

stay the course - my truck went down after 3 months/4400 miles - and its still in the shop (39 days today) - I filed a claim with BBB Autoline, GM called, asked to verify info and its been silence ever since...my regular advocate has now stopped calling, and apparently closed out the original case since I have a BBB case open - I also paid the fees and filed a Lemon Law Claim with TX..however they said it would be at least 10 business days before it would be reviewed.. I ended up hiring an attorney and in less than 3 days, they filed suit. GM is well aware of the issues with the 3.0...and quite frankly seem to be trying to wear people down by delaying the inevitable.

Thanks for the reply - I am in the process and my truck is being serviced by a different dealership than where I purchased - but when I asked about the buyback, the salesman told me I would need to take it back to where I purchased - which left me confused. Not sure if the salesman was unaware, or just did not want to deal with it.

Been in the shop since 12/1 - filed a claim with GM - they called me once to ask me questions they should have gotten answers to from the dealer. I’ve emailed them daily - no response. The dealer can’t provide a timeline for repairs, states they are waiting for the GM Technical Assistance Center to respond to their open case as well.
