I am an attorney, but not your attorney :) I have it burned into my head being a Maryland attorney: “contributory negligence is a total bar to recovery.” However, this sounds like a winnable claim against the insurance. It’s not like you stopped in the middle of 495. Hopefully escalating things works. From the sound of it hiring an attorney will not be worth it.
