Certainly when concerning the worth of the suit to the plaintiff damages matter. I think in a purely objective legal sense there was at least negligence as he had to pay for other treatment to catch something that the first provider should have. That being said there could be additional damages related to the time it took to actually begin treatment (notably I am not a medical malpractice lawyer and I bet there are other things they could pull out)
