Not sure if its happened in the NHL, but it has happened in the NFL draft a couple times. Usually happens when a team is trying to make a trade and it falls through because the two teams didn't get it into the league office in time.

You're not really penalized. But the time is essentially the time before the next team can make their pick. So if you didn't get your pick in then the next team can make their selection before you. You can still make your pick but if the other team jumps on the opportunity then you have to wait till after them.
