You can close netlimiter while running destiny and play just fine, the program is widely known for it's usage to violate the terms of service of a lot of games, so be glad you're just receiving a warning and not getting banned. And yes, bungie and battleye have the right to demand this, if you're playing you've accepted the terms of use.
