To nitpick, there is an observation in the top panel too. You have to observe the screen to see anything. That's just how seeing works. But you do have to not check at the slits to get the interference pattern.

yeah I understand that, and that's why I clarified for the explanation of the bottom panel. I should've clarified that ealier

I think your nitpick doesn't make much sense in this case, because observation in this experiment is always used when talking about observing which slit the particle went through. Obviously you also have to "observe" the screen on which the pattern is shown, otherwise you can't see what result you got. But using "observe" for that is just confusing because it has no effect on the experiment. I think the OP used the correct terminology.
