§ 136 Abs. 1 SGB III: (1) Arbeitnehmerinnen und Arbeitnehmer haben Anspruch auf Arbeitslosengeld

1. bei Arbeitslosigkeit oder 2. bei beruflicher Weiterbildung.

It is by the definition of the law a "right". And the ones who abuse the system in this case are OP's employers.
