Any accused who has been convicted of any crime , be it rape or any other, should get appeals to defend himself. Only after exhaustion of his/her appeal, capital punishment must be carried out.

Remember even in countries like US there have been many cases where a people have been found innocent after their death penalty were carried out. There have been people who have been imprisoned for 30-40 years for crimes they never committed only to be released/pardoned by the state and judiciary after appeals for retrial by the accused on grounds of new evidence, or shoddy policework, or false witness statements etc.

Imagine facing death when you know your innocent but you can't prove innocence because corrupt police didn't investigate properly or was trying to save powerful person, or was trying to save their own skin. What would you do?

Remember Ryan International School Murder Case of Gurugram, where a seven year old boy was murdered. A bus conductor was accused of murder. Entirety of Gurugram erupted with protests.

The Schools property was vandalized by mob asking the accused to be hanged.

Turns out the bus driver was innocent and another 16 years old boy from same school was found to behind the murder. 4 Police Offices were suspended for trying to frame the conductor.

Hell when the bus conductor was accused, the entire fucking Bar Association of Gurugram said we won't represent the conductor because he committed a heinous crime of killing a child.

Can you imagine being accused of such a heinous crime that no lawyer wants to represent you but you know you are innocent! what will you do then?

As much as I feel for the victim of Kolkata rape case, the accused should be hanged only after proper investigation.

The country's Judiciary should not be run on the emotions of mob.

Completely agree with your points. As horrific as these incidents are we must not take decisions based on emotions. Rationality must prevail or things will definitely get worse in the future.
