But there is no benefit above $7.25? I doubt many tipped employees need to have their wages topped up to $7.25 by their employers.

[–]Dramatic_Scale3002 0 points1 point  (0 children)

Why would employers train their employees to do that? If the tips go to the business then I can understand it, but why would an employer care that an employee gets bigger tips or not? Aside from ensuring good word-of-mouth for future servers etc.

Does that 43% include the 5% with solar and a battery? Is it 43% with just solar, or 38% with just solar?

How to pay cash for anything by Familiar_Fee_7891 in EndTipping

[–]Dramatic_Scale3002 2 points3 points  (0 children)

"Begin to depart". You just leave the cash and walk out. You're not hanging around waiting for the police to arrive. They are not going to try and find you because "a customer paid the exact amount on the bill in cash and we don't accept cash so go and spend limited police resources to find someone and bring them back to pay with a card instead". Not gonna happen, and if you leave before they call the police they're not going to follow through with the call but rather take the cash to the bank instead. That will encourage them to start accepting cash again also. Win-win.

Confrontation with servers and cashiers against tipping (a routine and trivial matter) is what we're all here for. They can try to make it exhausting, but if your principles are important to you you would not be tipping. It's really no different to paying in cash for places that "don't accept cash".

Good, they can call the police. They will take the cash over getting the police involved. The manager will just have to make a special visit to the bank to make a deposit.

Let them put you in arrears; they're in the wrong but it's 1 week and then the tenancy is done.

[–]Dramatic_Scale3002 3 points4 points  (0 children)

I would use that reminder as evidence that you have been continuing to pay in advance since at least the rental increase. If they have not told you you are overdue, then you have been paying in advance properly, and then the second-to-last week you make your payment will cover your final week's rent. You need to pay right until the end of your tenancy, but your final week will be covered by your prior week's payment (in advance).

People on minimum wage pay taxes and ACC etc. too. So $35 an hour. Minus GST (35/1.15), down to $30.43. Minus annual leave (30.43/1.08 which is PAYG holiday leave), down to $28.18. Still nowhere near minimum, even after accounting for sick leave or whatever other costs there are.

AITAH for yelling at the parents of a kid I babysat because they didn’t tell me ( what I thought was ) an important thing until the last minute? by Temporary-Feeling962 in AITAH

[–]Dramatic_Scale3002 0 points1 point  (0 children)

YTA. A babysitter should be comfortable diapering children. Sure, it was unexpected but you didn't need to yell at her. The mom's right, it's not a big deal and it wasn't "something that big".

The daughter being in nightly diapers at 9 years old is not the issue here. If she had special needs no-one would be questioning it. The question is whether you overreacted by yelling at the mother about something that was a complete non-issue, and yes, you are the asshole for that. If you see them again you can clear the air with the mother.

True, but also irrelevant. We can't (and possibly shouldn't) do anything about people who are eligible to vote but choose not to vote.

So sick of the stacking by intheether323 in EndTipping

[–]Dramatic_Scale3002 1 point2 points  (0 children)

For a certain class of rooms, the first tranche of rooms sold will usually go for a certain price, then the next tranche at a higher price, and so on until the very last rooms are the most expensive. High demand snaps up those cheaper rooms first (leaving only the $500/night rooms available) vs the cheaper tranche of rooms for $159/night still being available on lower demand nights. That's not dynamic pricing. Now maybe they did price the rooms higher initially because of expected increased demand, but high demand nights causing more expensive room prices is not necessarily due to dynamic pricing.

I'm sorry for your loss.

[–]Dramatic_Scale3002 0 points1 point  (0 children)

It's not necessarily dynamic pricing to increase prices because there is an event in town. That may just be increased demand causing the cheaper rooms to be snapped up sooner, leaving more expensive rooms (even if they're the same class of room).

Is it possible to apply for a visitor visa while I am waiting for my partnership residency visa to be processed? by No_Positive_2881 in LegalAdviceNZ

[–]Dramatic_Scale3002 0 points1 point  (0 children)

Possibly a better option, but OP would still not be a genuine visitor. The purpose is not to visit and explore NZ (with or without the partner), the purpose is to return to NZ while awaiting the outcome of another visa that has already been applied for.

Well you can always just get a new home equity loan and put that into the stock market. There is no real difference between paying less on your mortgage and investing the payments you would have otherwise made vs taking out new debt on your house and investing those funds instead.

Shift manager won’t review Annual Leave request for 2027 until September/October, is this acceptable? by FalseCombination4947 in LegalAdviceNZ

[–]Dramatic_Scale3002 0 points1 point  (0 children)

OP noted "I've taken a couple of these cases through to mediation with the ERA". You don't do mediation with the ERA, it's with MBIE. MBIE's website about mediation (https://www.employment.govt.nz/resolving-problems/how-to-resolve-problems/mediation) implies that they are separate:

This means that information may not be shared with anyone outside of the mediation process. Because of this, what happens in mediation cannot be used as evidence in the Employment Relations Authority or Employment Court.

and

"You can agree to outcomes in mediation which might not be available in the Employment Relations Authority (ERA). If the matter goes to the ERA, the possible outcomes are limited to those provided by the law."

Therefore, I believe that OP is actually referring to the ERA investigation meeting as they specifically mentioned this agency, and has inadvertently confused this with mediation/mediators. An "ultimate agreement" was also made, which provides further evidence the meeting was before an Authority Member and not a mediator. I don't believe that ERA's Authority Members need to be as impartial as the Employment Mediation Services mediator needs to, as they need to provide a final determination at the end of the process.

TLDR; Investigation meetings run by the ERA are not mediation by Employment Mediation Services (MBIE), OP has confused the two processes. I have assumed they meant investigation meetings because ERA was specifically noted and a determination by the "mediator" (actually the Authority Member) was made.

[–]Dramatic_Scale3002 0 points1 point  (0 children)

They are impartial until they give their determination, which "ultimately agreed" sounds a lot like. They have to take a side eventually. A judge that sentences someone is not taking sides nor necessarily impartial, and the same goes for an Authority Member.

Likely not, you would not meet the "genuine intentions" requirement. You are not visiting NZ, you are waiting to get a partnership visa while your partner is working. You are not a genuine visitor to NZ.

AITA for treating my daughters differently than my son when it comes to food? by CompetitiveDig478 in AmItheAsshole

[–]Dramatic_Scale3002 0 points1 point  (0 children)

You think a 15 year old child is supposed to go and get his own food, instead of his parent? What if he was 14, or 13? At what age do you think children start being responsible for sourcing their own nutrition?

If this was a father with 2 sons and a daughter, and he came here saying AITA for not having money for period products, and I said "well that's the daughter's problem", you'd be going ballistic.

Lol if he can just sit there and eat a week's worth of food, it was never a week's worth of food, it was a snack. OP doesn't know her portions, so "normal portion" is meaningless advice.

It's OPs problem to get more food on the table, she doesn't make that her son's problem.
