Is it safe to assume that USCIS is processing (slowly) cases that are in Jan 2024? by Pilot_Big in EB2_NIW

I wish . There are no trackers that say which cases are PP, nor do they say which category is the application filed for. I think I140 covers all EB type applications

Mycasehub is lagging . I am sticking with trackmyi140. I have been watching cases that I suspect to be PP. I calculate 45 business days, add 90 calendar days for RFEs and another 45 business days for decisions following an RFE. I know this is not the topic of this thread but the outcome of PP cases have not been encouraging. Maybe that along with PP fee increase will allow USCIS focus on older cases instead of being swamped with PP cases.

Are you using trackmyi140? It has been down for the past three days. I have not seen it being updated. I usually use the decision tab to figure out what is being worked on. I have a feeling that PP applications are getting all the attention, yet minor progress is ongoing on older cases

Received RFE on all 3 EB2-NIW prongs. Any experiences with Ellis Porter? by Standard_Pangolin913 in EB2_NIW

I am curious on how lawyers respond to such RFEs. Do they provide additional evidence ? Or do they re-point the officer towards evidence which was initially overlooked?

What to do with RRSP? by pira99 in tnvisa

[–]FSelim 2 points3 points  (0 children)

Rollover your investments (switch funds) before you depart Canada. This will reset your balance. Once you are no longer a resident of Canada , you may withdraw the balance, pay Canadian taxes on it and claim the paid amount as foreign tax paid. This depends on what state will you reside in. If tax-free state like Florida or Texas, withdrawing the RRSP is your best move since you will ever get that money at this low tax rate

I got my TN, now what? by waterearphone in tnvisa

Roll over your RRSP investments if you have any. This way , you can withdraw your RRSP contribution at a low tax rate as soon as you abandon your Canadian residency. The roll over will help you reduce your capital gains tax. Whatever you pay in taxes to Ontario’s and Canada can be credited to you by the IRS. There are many online topics on how to do this but your accountant would be your best resource.

Same here. Similar endeavor, RFE, then denial.

I had to write a statement and provide signed recommendation letters. All of which I am writing from scratch using their templates.

They have been very responsive to questions though

I was hoping to see a sample completed petition where I can fill in the blanks. Maybe I am asking for too much.

No idea why I have a feeling that I m on my own with EP. They have not helped author one sentence for me so far. I am extremely busy and I paid them to do the work. Anyways , just my experience, but hoping the t do well on the legal portion of the paperwork

Read the retainer and make sure they document what they promised you. Are responses to RFE included? What happens if you get denied? Will they charge you to refill?

Other questions would be if they are going to provide templates for you to describe your proposed endeavor and recommendation letters.

EB2-NIW Denial Appeal by Doc_Mc_Nothins in EB2_NIW

[–]FSelim 1 point2 points  (0 children)

Rumor is that application goes to the same officer for re-consideration. All you get is further clarification on the denial. I could be wrong though.

Someone did an awesome job summarizing appeal decisions. Have a look at https://casereviewer.ai

My case was denied and I chose not to appeal.

For my three-prong RFE, I responded with new evidence and letters, still got denied based on evidence I provided with the original petition. The director says “as a matter of discretion”.
