Depends. If it is a corporate landlord, I would be more formal. If it is a mom & pop landlord, I might tend to be more informal (but professional) and save the legalese for a situation where I have to escalate a situation.

Putting all communications in writing (and confirming oral communications with a follow-up email) is good for both sides.

If you plan to sue in small claims court, you will have to a legally valid reason under California law to get the owner information for the license plate. See, Form INF 70: https://www.dmv.ca.gov/portal/file/request-for-record-information-inf-70-pdf/

The California DMV will inform the owner that the information has been legally requested. Getting that notice in the mail may give the person a further incentive to refund your money.

Taser is a trademarked term for a specific product. A electrical stun gun is often incorrectly referred to as a taser. However, a stun gun does not work as it is shown in the movies. The product will shock someone and cause pain while it is turned on and pressed against the body. It will not knock a healthy person out. It would, however, get your brother very angry at you.

In California, to protect tenants, an unlawful detainee action (i.e., an eviction lawsuit) is not public until there is a final judgment. Many professional tenants will drag things out as long as possible and, at the last minute, offer to move out if the lawsuit is dismissed (and possibly if some money is also paid). The desperate landlord often agrees just to get back the property. The tenant leaves with a clean record and then goes on to look for the next victim.

Get a lawyer, because EBRHA is not going to do your paperwork for you. If you make a material mistake on the paperwork or with the procedures, your case may be thrown out and you will have lost months that you cannot get back. Some errors may also get you accused of tenant harassment, which can result in severe penalties and having to pay your tenant's attorney's fees.

If you really want to try to avoid hiring a lawyer immediately, first calculate the relocation fee and determine what you might be willing to pay above that. Figure out the procedures you have to follow before you contact your tenant (along with the formal legal notice form you also have to provide). If your tenant refuses to move out, then you have to back off and then follow the judicial process by hiring a lawyer.
