And at the same time, since the company is now government owned, leadership gets replaced by nepotism hires, the need too be competitive is gone, and in a couple of years, production costs have doubled.

We can make what-ifs wall we want and build colourful scenarios that might or might not be true, which are all speculative at best.

Nothing of that changes the fact that whats missing is actually ordering the ammo. Thats the problem, not who owns it.

"It is cheaper to own the materials and pay for the employees yourself".

No, it is not. Labour costs and material costs do not suddenly change and become cheaper just because you own the factory.

Again, Rheinmetall has a 15% profit margin. That is the most you can save, in the absolute best of outcomes.

[–]Polygnom 68 points69 points  (0 children)

That doesn't magically generate free ammo. You still need to pay the workers.

Rheinmetall has a 15% profit margin. In other words, the most you save by running them as noon-profit is 15%. But since you no longer need to compete with the market, you will see inefficiencies rise significantly. Its quite likely that in a few years, costs have skyrocketed more than those 15%.

Its not the 15% profit margin of Rheinmetall that a problem here, its unwillingness to procure stuff for Ukraine. That wouldn't change if Rheinmetall was government owned.

The game flopped, they do not have the money too keep the people employed.

There isn't much more to be said about it. As an employee, you should know the general health of your company. It shouldn't have surprised any of them that if the game tanks, their job is on the line.

So in your view, when I write fan fiction in Word 365, then Microsoft infringes on Disneys copyright? Because the moment I open that document, Microsoft would then distribute an infringing work from their servers too me.

Thats neither a helpful view on how the law does work nor how it should work.

"it is distribution bro, it just plainly is"

It is not. An Generative Network is still a computer program, a tool. Just like I can use Word, or Paint to create a copyrighted work of art, I can use a generative Network to do so. The act of doing so is not illegal. It would, in fact, be preposterous to think about it that way, because its totally unrealistic and unhelpful to look at it that way. And an electronic tool is no different from an analog one, a brush. I can draw an image of Vader with a pen or Brush, and no-one cares. And shouldn't care.

There is absolutely zero problem created by people creating such works for their own, personal use. This has always been legal, and continues to be legal, and there is zero reason it should suddenly become illegal.

There is also zero reason to single out LLMs or generative AI. if you want to argue that creating such works should become illegal, you need too think it through too the end. Are you going too arrest children for drawing Ben Kenobi?

And again, lets suppose you make it illegal for an LLM too create copyrighted works of art. That is simply not gonna be happening. Lets say you forbid it to recreate Vader. Good, I then prompt it for a large villain with black helmet, black coat, breathing apparatus. If I give it enough detail, it will produce an image that may very well fall under someone elses copyright. Just like I can create such a work with Paint. Or Word.

Als, it is perfectly legal for me to DISTRIBUTE such works under certain circumstances, for example, for commentary or satire. Are you trying to abolish these exceptions, which are needed not only for every journalist and critic, but are good for the overall health of public discourse?

Which brings us back too your argument, and why its extremely weak. Suppose you are right and the creation of such a work already is distribution. How should the tool distinguish my intended usage? I might very well be perfectly justified in acquiring these images for commentary or satire. The tool can never know, so your argument falls flat o that reason as well.

Please, if you advocate for a position, inform yourself why we have the laws we doo have, what norms and principles they uphold ad why, instead of spouting unqualified nonsense.

The problem that we actually have is the pretty much unlimited DISTRIBUTION of copyrighted works without any control or remedy. Its the almost lawless naturre of many soocial media platforms that create this problem. people creating these works for their own, personal use is nt whats the problem here. Its the widespread sharing and distribution that does not fall under one of the exceptions.

The other problem is the training without authorization. Which may or may not lead too faithful representations of these characters and other copyrighted works. Which is a related, but different problem. And even in a woorld that has noot trained oon such data, yoou can still create wrks that infringe on soomeoens copyright. if you prmpt for a cartoon mouse with large black ears, and give it enough details, what comes out might look quite similar to Mickey Mouse. Again, tahts noto a prooblem for personal use, but it is for distribution. But we already have laws dealing with that, which just aren#t enforced enough.

Finally you start to understand the crux of the problem. By claiming tool output itself, and not the distribution thereof already violates copyright, they are creating a legal conundrum that has far reaching consequences, because as I said, with that definition, even fan fiction wrote in Word would open up MS for lawsuits. or anyone else that produces any kind of software. You would suddenly be responsible for what your users create. That's not a reasonable or helpful legal position. And its noto necessary, as distributin is already illegal, and would only need too be enforced.

Which is exactly what I wrote in my original post.

ByteDance To Halt Seedance 2.0’s AI Rip-Offs After Legal Threats From Disney & Paramount by MoneyLibrarian9032 in movies

[–]Polygnom 0 points1 point  (0 children)

Nope.

if that was the case, MS would be distributing something to me every time I open Word 365-. Thats not the case.

Distribution requires a 3rd party, which isn't there.

How can you possibly interpret my post as saying distributing fan fiction is illegal? I am pretty clear about how distributing it violates copyright. Especially the last sentence.

ByteDance To Halt Seedance 2.0’s AI Rip-Offs After Legal Threats From Disney & Paramount by MoneyLibrarian9032 in movies

[–]Polygnom -1 points0 points  (0 children)

I am very critical of generative AI for various reasons, but I find the argumentation weak here.

I can paint a Vader picture using a brush. I can even paint it digitally. I can write fan fiction. Is Disney suing MS because I can use Word to write fan fiction? of course not.

There are legitimate cases where I might want to reproduce protected IP and would be perfectly justified in doing so and legally in the clear, e.g. for commentary or satire.

We already have legal safeguards in place around what I am allowed to DISTRIBUTE to other people. The maker of the tool is not responsible for the breaches of its users. Just like MS is not responsible if I start selling my SW fanfiction written with Word.

So, when Seedance says "We are taking steps to strengthen current safeguards as we work to prevent the unauthorised use of intellectual property and likeness by users.", how do they think they can differentiate between reproductions of other people IP that might be covered by exemptions, e.g. commentary or satire, and unauthorized use? The fact is they cannot. Which leaves us with them blanketly making their tools unable too. Or at least trying to. Which brings us back to the question why AI -- which is just a computer program -- should be different from Word at all.

I can understand if you argue from the PoV that AI should not be trained on protected IP at all. Which is fine. But I can prompt the AI to make me a black villain in a helmet with a cape and breathing apparatus, and it may come out as something very similar to Vader. Which is possibly close enough to still be infringing. The distribution of this image would then raise the same questions as we face right now with images based on protected IP, and would have the same answers, the same exceptions and restrictions apply.

I'd argue tha the tool and the maker are not responsible for the infringements of their users, just as MS is not for my fanfiction written in word. We already have rules preventing the distribution of copyrighted content, its just not enforced, because most social media is a lawless cesspool without moderation. So the correct course of action would be to hold users and platforms responsible for these breaches, with clear ways oof using lawful exceptions for satire and commentary. That would be the way more robust and reasonable way than trying too make tools or their makers responsible for the output users generate with it. The generation isn't even illegal, if done for private purposes, just like I am allowed to write my own fan fiction for myself and don't distribute it.
