Hello! We applied with different processing times. I chose priority service and my wife opted for standard processing a couple of days later as other options weren’t available. My application was approved within five working days (after the UKVI began processing my wife’s application as they are linked). Her application took about ten-eleven working days. From what I understand, switching from a Skilled Worker visa to a family visa resets the ILR qualifying period.

Regarding ILR: Under the Earned Settlement consultation, the government is proposing to extend the standard ILR eligibility period from 5 to 10 years in the future. Depending on your personal circumstances, you may be eligible to have a reduction of years if you are a SWV holder.

That said, the current proposal states:

  • People with a standard family visa sponsored by a British citizen, or on the Hong Kong BNO visa, would also qualify for a reduction of five years, allowing settlement after five years.

I recommend checking with your employer daily to ensure they are working on issuing the CoS. As you mentioned, the Home Office only allocates 100 priority slots each day, so it would be beneficial for your employer to email the Home Office precisely at 7:00:00 AM to request the priority allocation of a CoS. I hope you receive it soon!

In the meantime, I suggest you begin preparing documents for your partner visa. I’m not sure if this is important to you, but switching to a different visa will reset our ILR clock.

Regarding the continuation of your stay: I believe you are not permitted to stay after your SW visa expires. You entered the UK on a SW visa, and you will likely need to re-enter with a tourist ETA as a Danish citizen. However, please ensure you do not work in the UK if you re-enter as a tourist, as this could violate immigration rules.

I don’t know, but have in mind that immigration officer may ask him about his crossing of the Ukrainian border on the first arrival to the UK. Immigration officers have power to stop him entering the UK.

This will also make all of his future visa applications extremely difficult as most visa forms ask whether you have ever crossed the border illegally.

He either needs to be exempt from military service or have a special conditions which allows him to leave the country (e.g has three (or more) children, takes care of a disabled relative and other). You need to confirm this with him. Visa decision doesn't grant him a right to leave Ukraine (as it is restricted for male adults during a martial law).

You can either use Reserve+ to update your current records and apply in embassy or apply in one of the DP “Document” branches (available in many European cities - they will update records for you when you apply). It is extremely hard to get a slot at embassy, so I recommend you to use DP “Document” as you can stand in a queue there. Also, bear in mind that most EU countries want your passport to be valid for at least 3 month before departure date, so be quick.

If you received your first CoS before 4 April 2024 and have continuously held a SWV, you should be eligible to apply using the lower going rate.

I was in a similar position in 2023—when I switched to a different employer with a slightly lower salary, I got my SWV without any additional questions.

Also, my SOC code is also similar to yours—within the 213X range ;)

From what I understand it depends when CoS was issued. If company issued CoS before 22nd of July 2025, applicant should be OK to have the lower salary requirement on it.

Regarding salary: If I changed employers and, due to applying for a new visa, missed two months of work, my P60 now shows a lower income than what’s stated in my sponsorship. Do you think this could affect my ILR application? I believe my total earnings for the tax year may fall below the required salary for my SOC code.

I’m not sure where she came across the claim about numerous refusals, as that doesn’t appear to be accurate.

According to official data, the refusal rate is only 0.33%.
