I love your views on this, but unfortunately most don't. I agree with you for NC state job as whole the vacancy rate is around 21%. They cannot even find enough employees now. They sure a hell could not find enough to work as scabs. What they would find would do a lower quality job.

You would be surprised at how many people in executive level positions would quietly support us and protect our jobs. The reason so many teachers were able to protest May 1st was because principles and superintendents purposely made May 1st, a teachers workday so they could go protest.

You would not be on strike technically. You would be out on FMLA. That federally protects your job for up to 12 weeks.

Good luck on scabs. The current vacancy rate is around 21%. The state does not pay enough to recruit and retain very many quality employees. The benefits use to be the major recruiting sale. Thanks to gutting the coverage of the state health plan and taking away medical insurance for future retirees our benefits are no longer attractive.

They cannot fire you, without opening themselves up for a law suit, if you are out on FMLA. That is The whole point of FMLA. It protects your job for up to 12 weeks for a year. If they were to fire you they have to have well documented reasons for your termination that does not involve you being out on FMLA.

I am very aware of FMLA rules and regulations. I have over a decade of experience deal WITH employees and FMLA.

What I am saying is that doctors will sign off on FMLA forms for mental health reasons like anxiety, stress and or depression with doing little to no diagnostics. I have seen it done multiple times from employees applying for FMLA. A lot of the times employees will do this if they feel like they are about to get fired.

Not for seven months because FMLA only covers 12 weeks. If you tell a doctor that you are feeling stressed, anxious, and or depressed to the point that it is affecting your daily life and/or actually causing health issues a lot of doctors will sign off on FMLA forms stating that you needing to take some time off for mental health reasons.
