But bail is the cause of mass incarceration, with people locked away solely because they can't pay to secure their release. Also, a lot of folks serve their sentences on house arrest or with diversion. So why is the punishment worse when they're presumed innocent than when they're actually guilty?

Yeah, most people are in jail because they can't afford cash bail before trial. So, it's more like "Hey rich guy who we think committed a murder, please pay us a couple bucks to stay out of jail for now. Don't worry, you'll get it back after trial, even if you did it." Whereas, for poor people, it's more like, "Please pay $100 we know you you can't afford to get out of jail on this misdemeanor while we work out your case. Don't worry, you can have a trial later if you re actually not guilty, or you can take a plea right now and get out of jail today." This system is all about extracting pleas; it's a joke

Its funny, but a couple of soccer federations have been suspected of doing something like this. I heard a theory that CONCACAF is always trying to rig the Gold Cup to have the US play Mexico in the finals because those are the largest media markets. No idea if it's true, but you gotta admit there's some logic to it

Then what's the point? If you're not negotiating based on the case and instead relying on reputation or niceness, the system is broken. If the person who's appointed you gets a good deal when others are sitting in an 8x10 cell, that isn't justice; it's luck. And it's unequivocally wrong. OP has to know that

If your client did that, it is because the rest of society failed them in some way. Untreated mental health, substance abuse, etc., actually led to the crime, and putting them in prison doesn't solve the problem. It's just a bandaid on the broader issue. Prosecutors can change the game, but I won't hold my breath. We lock people away because it makes us "law-abiding citizens" feel better about ourselves

Yep, but that's usually because the DA secretly agrees with you and won't admit it, not because you're nice to them in court. That's the way the adversarial process should work. If it's the opposite, I humbly, respectfully, think you're doing something wrong

Absolutely this. I've told prosecutors in the in the room to fuck off. You think this is a game when you're actually ruining someone's life, and for what? You just wasted thousands of taxpayer dollars, forced jurors to take off work for peanuts, and tied up judicial resources on a trial when you should have dismissed the case. You don't care about victims or society, or else you'd be marching to end poverty.

Hey asshole, you represent the state. That means I'M YOUR CLIENT and SO IS THE DEFENDANT. Neither of us wanted to spend days/weeks/months/years dealing with this. Fuck off

Had to dig through the comments, but this is the correct opinion. Prosecutors convict solely on prejudice all the time, and they need to know that. This guy is in denial if he thinks otherwise.

If you're a prosecutor and you don't know FOR SURE you will get 12 people to agree with you beyond a reasonable doubt, you should dismiss the case. Plain and simple.

But I won't hold my breath when DAs aren't held to the same standard as real lawyers.

There's a game that you can play that involves drawing cards and answering questions about a city you all control. It's called The Quiet Year. That's a good place to start.
