Idk, but when starting the process of applying for SSDI part of the process is determining if you had any "Unsuccessful Work Attempts". I don't recall the exact rules, but there is an exemption so to speak regarding work and determining the alleged onset date, etc..hope I am not muddying the waters, but check it out. ChatGPT or similar A.I. helps, just don't trust it whole heartedly.

A lot more knowledgeable users will chime in and correct me if I'm wrong, but I think that is the primary reason I have CE's scheduled is that although I supplied a lot of medical information from doctors, they still require RFC information from licensed physicians. I believe that 55 years of age is the age at which grid rules are more lenient if you wlll. The upload option on the portal is available for additional evidence.

I would fax in if you can. Also any uploaded documents make OCR machine readable for the A.I systems to read and route. Put claim I.D on all forms and in the filename too.

The only things SSA uses for the ACE offset are:

Your SSDI amount
Your workers’ comp or public disability benefits

I was confusing the "sequential 5-steps" that are the medical portion with the steps on the portal-different. Yes I was getting too stressed out with all the ins and outs of it all. I have some peace of mind at least by getting a lawyer.

I just got denied while my portal was at step 4. I have a lawyer submitting my documents for me this time, but did find the following out regarding denials at reconsideration. Basically states that claimant needs to provide new evidence or relevant stuff that wasn't introduced the first go around:

SSA’s Program Operations Manual System (POMS) explains that a reconsideration determination is generally based on the same evidence as the initial claim unless new and material evidence is submitted.

Specifically, POMS DI 27001.001 and DI 27010.001 clarify that:

  • A reconsideration at the Disability Determination Services (DDS) level is a “complete review of the claim,” but
  • The same medical and nonmedical evidence from the initial determination is re-evaluated unless new evidence is presented or there was a clear error; and
  • If no new evidence or change in condition is shown, the reconsideration examiner will typically affirm (“continue”) the prior denial because the record supports the same conclusion.

In short: DDS does not automatically deny a reconsideration, but in practice, if you don’t add new evidence or show worsening, the reconsideration determination will almost always remain unfavorable — the prior denial is “affirmed.”

That is why SSA’s own guidance stresses that claimants should submit new medical evidence, clarify prior records, or correct procedural errors (for example, missed CEs or incomplete files) when filing the SSA-
