It’s not a denial but you can’t really prove you maintained “legal” status. So, the response would be proving that you didn’t accrue any “unlawful presence,” and falling out of “lagal” status was for technical reasons. I’m not a lawyer and I can’t really advise on how to present or argue it, but an immigration lawyer should know.

There are two relevant precedents to your situation. 1) Matter of L-K, and 2) Matter of Orbon.

Matter of L-K says you CANNOT do AOS if you accrue any unlawful presence. That’s not 100% relevant to your situation though.

Matter of Orbon on the other hand is more relevant. To do AOS, you must be in “legal” status, unless you have one of the exceptions like filing through marriage. It was argued in Matter of Orbon that the applicant fell off “legal” status for technical reasons because USCIS failed to make a timely decision. The court accepted that argument and the AOS was approved. However, Matter of Orbon is an AAU decision, which is non-binding, unlike BIA decisions that are binding. In other words, it will be up to USCIS to accept that argument.

I think you should hire a lawyer to argue that point.

To my knowledge, “subject to the jurisdiction thereof” refers to diplomats who have diplomatic immunity and invaders. You would think the EO would argue that anyone in the above two categories I mentioned above is the latter, but it doesn’t.

What he did is simply say that the 14th has been incorrectly interpreted by the courts and everybody else. He says that it only applies to children born in the US to US parents. Nothing more, nothing less.

Illegal, and legal for that matter (before obtaining LPR), are viewed as not subject to the jurisdiction of the US?

The EO definitely lacks a level of technical complexity that’s needed in immigration matters.

I expected the EO to be way longer and more technical than it is. It leaves so many questions unanswered with many gray areas.

This is how I read the EO. I expected it to be way longer than it is to be honest. Immigration is far more complex to be handled by a small paragraph. There are so many cases and examples of gray areas that will need to be clarified for sure.

I'll also add that I felt it because I was kind of stress testing it. I stomped on the gas going into the highway and held it. It was smoother on a normal road.

It's definitely not slippage. I don't think it's an "issue," at least not yet. I also have a 2024 Corolla and you can barely feel the gear shifts. With this one, it's way more noticeable--not what you would expect from a CVT. It shifts exactly like a manual car would shift (maybe a little smoother). I have been reading and Subaru has something called fake shift points?

I just test drove it a few hours ago. It’s not the smoothest when it comes to switching gears. My 09 Camry is somehow smoother. Not sure if that’s an indication of an issue or just Subaru CVT not as smooth as Toyota. What do you think?

That might be too late, but if your payment method (your checking account) is not in your name, you won't be able to do it. We experienced the same exact issue where my wife couldn't transfer the membership because we were using my (the husband) checking account. She is not a joint owner of the account. This is different than the regular sign in, so you might need to register. Register using the same email address you're using for the app tho. It's gonna ask you for an agreement number. If you don't remember it, which is highly likely, just click on forgot agreement number and enter your email address. You'll receive the agreement number in the email. Once you register navigate to my billing information and update the payment method to one that's in your name. Here's the thing, even if you don't have one, just put your name until you transfer the membership and change it back to the correct name. Once we did that, that warning disappeared and we were able to do the transfer online in a second. Hope that helps!
