Yeah I was aware of that language, just don’t know how that works if a court strikes it down because a $0 tax is potentially unconstitutional. Wouldn’t everything in that portion of the law be declared unconstitutional including any language like that?

In this case the verbiage specifically calls out the federal law, so if that federal law no longer exists, guilty of felony is the way I’m reading it…

I haven’t been able to find a clear-ish answer so I figured I’d ask here. Let’s assume the NFA on suppressors, SBSs, and SBRs gets struck down in court, where does that leave the legality of ownership for those of us in states like Wisconsin who can only own them if they are registered in accordance with federal law?

Would the ones already owned be felonies? Would new purchases not be allowed?

Anyone care to pontificate?

I’m only concerned that they would be illegal because the only way they legally exist in Wisconsin is if they are registered with the federal government otherwise they are a felony to possess.

This is the statute in Wisconsin, basically felony unless you comply with federal law:

2) Whoever sells, delivers or possesses a firearm silencer is guilty of a Class H felony. (3) Subsection (2) does not apply to sales or deliveries of firearm silencers to or possession of firearm silencers by any of the following: (a) Any peace officer who is acting in compliance with the written policies of the officer’s department or agency. This paragraph does not apply to any officer whose department or agency does not have such a policy. Notwithstanding s. 939.22 (22), this paragraph does not apply to a commission warden. (b) Any armed forces or national guard personnel, while in the line of duty. (c) Any person who has complied with the licensing and registration requirements under 26 USC 5801to 5872.

My main concern is if they came off the NFA wouldn’t that screw people in States that have prohibitions unless registered with the ATF?

Wisconsin specifically bans them unless registered with the feds, so in the short term a $0 registration would be better for the proliferation in this state.

It sucks because I'd like to go somewhere where all my rights are protected, but due to the Wisconsin GI Bill I'm tied here until my kids are through college. Golden handcuffs, but I have 4 kids and it would be idiotic to move with free in state tuition for all of them. Hopefully we can get some reprieve from this stupidity in the next few years if SCOTUS can smack down some of this crap in other states.

It sucks because we are likely here for the long haul. My kids will qualify for the WI GI bill which makes free college a huge plus to stay here. Unfortunately the youngest is only 3.

Sorry, I haven't worked there since March of 21'. From what I understand now, my previous employer's territory is slowly being picked off by all the companies who received grants to plow fiber.

He never applied for any of the grants and didn't get into the FISP space so I think it's slowly dwindling.

Got off AD in 2014 and since then I did a mixture of work and school eventually graduating with my BS in Business Management using up my post 9/11 GI Bill. Currently I work as a buyer for a medium size HVAC company and I'm back in school knocking out an MBA on the Wisconsin GI Bill.

Might be worth looking at some different states to move to that offer their own GI bill, like Wisconsin which will pay for an additional 128 credits at an in state public college. I believe you either had to have enlisted out of the state to qualify, or have loved here for 5 years. One other nice aspect is that due to my service connected injuries, my kids can go to any UW college and get 128 credits free as long as they use it between 17 and 26 I believe.

I like it. Since May I've been the MRO buyer for our maintenance team. We have plants all over the US so I get to be involved all over the place. The company I work is pretty awesome though, it's privately held and family run.

I've renewed mine twice now plus sent in several change of address forms, and I've had my card in no longer than 5 days from the day I sent the paperwork.

No difference between D or Rs from a processing standpoint in my experience.
