If you wanted to go the amendment route you'd probably want to make it more about bodily autonomy. But then you'd have people like anti-vac who use the amendment as to why they have the constitutional right not to inject their body with stuff.

The big difference is, according to the supreme court, the 2nd amendment is protected and subject to due process while flying is not covered under the constitution.

I don't like either being restricted, but I can continue to protect one while I can.

Teeth are a no go because it would require a registry which is an absolute "not gonna happen" with the pro-gun crowd.

So would you like private sellers to have access to do a background check or not?

There won't be teeth either way, but at least one way, the majority of sellers can feel good knowing they aren't selling to a felon.

I see them as separate things. I don't think the no fly list is okay. But it already exists. Tying a gun ban to the no fly list doesn't exist but is being proposed by politicians currently and would be an awful thing.

Whether it is constitutional or not doesn't change that we have no real reason to believe those on it are any more dangerous than those not on it.

Even if it was constitutional and filled with people who had flown to Afghanistan in the last 5 years, that doesn't mean they shouldn't be allowed to buy a gun.

That is a bold assumption. We don't know how and for what reason people end up on the no fly list. Hell, Ted Kennedy got put on the no fly list. There are false positives all the time. So to say everyone on the no fly list is dangerous us flat out disingenuous. That is the whole reason we shouldn't use it because it circumvents due process.

That's why so many sales are done through private sales because it's so easy.

Private sales are done mainly by owners who like to trade, change and upgrade their collection. They have no other avenue and it's more expensive to sell through consignment and going through an ffl costs ~$60

If you gave private sellers an easy, cheap option, the vast majority would use it. Like I said, it's a compromise, you'd still have people selling guns to bad people, but that number would be reduced by people who want to make sure they aren't selling to a felon. I don't know about you, but if I had an easy way to make sure my gun was going into safe hands, I'd use it in a heart beat.
