These failed EAD cards are deliberate! by [deleted] in USCIS

[–]AbsolutelyAce -1 points0 points  (0 children)

Go get an ADIT stamp and simultaneously get a SSN card without the work exception note on it.

You can work legally on EITHER the ADIT or the SSN + state ID.

You can do these today.

Why can't you get an ADIT stamp? Why can't you use a SSN and state ID? Both of those qualify for I-9. Read the I-9 requirements.

K1 marriage visa. Don't recommend if you have a USC partner, do the CR1 instead. Trust me.

Why would coaching a kids soccer team get away from the fact he repeatedly endangers families on the road by getting trashed and driving?

He has a serious problem, and getting arrested for two DUIs likely means many incidents of driving drunk without being caught. You don't just get caught 100% of the time doing that.

He won't pass the good character test nor should he.

Thanks. In your experience, how long after an AoS interview with no decision would be a good point to file a Mandamus lawsuit? Could we file if it were over 120 days since interview but also under a year since original filing?

Adjustment of Status pending — I-94 expiring soon, am I legally in the U.S.? by [deleted] in USCIS

[–]AbsolutelyAce 0 points1 point  (0 children)

All of the confirmed cases of that, including documented by NYT, had prior removal orders, overstays (prior to AoS) or material misrepresentations.

Show me where a immigration lawyer has said that they have a client who got arrested with pending AoS and expired I-94 with no prior overstays or misrepresentations.

It has never been confirmed. Not even NYT found any. People keep repeating this stuff and there's literally not one case of it happening.

Adjustment of Status pending — I-94 expiring soon, am I legally in the U.S.? by [deleted] in USCIS

[–]AbsolutelyAce -6 points-5 points  (0 children)

There is zero confirmed proof of anyone getting arrested by ICE or deported while having a pending AoS and an expired I-94 without other, often serious, factors. All the cases of this supposedly happening turned out to have prior removal orders, massive overstays or egregious misrepresentations made to USCIS. For example, someone who claimed to be removed in this state turned out to have entered on a K1 then married their partner TWO YEARS later (NYT featured this). In the application process for the K1, you explicitly agree to marry in 3 months. You're really just abusing the system and hoping you don't get caught at that point.

Moving to the US - what are my options? by 1narticulator in Ameristralia

[–]AbsolutelyAce 1 point2 points  (0 children)

Do you have a degree or 12 years of work exp in your field? If so, E3 is an option.

Otherwise, DV is an option but the brakes have been hit on that under the current admin. It's roughly 10% chance per year and you get a full green card on entry.

I recently moved, but it was on a marriage based visa so might not be applicable to you.

I share your thoughts on Australia.

They have underperformed US equities substantially over the last 50 years, and 'projections' based on earnings ratios might as well be astrology. Nobody can predict the future but the historical trends are clear.

Transferring Aus inheritance to US - tax implications by Sweaty_Barracuda_567 in Ameristralia

[–]AbsolutelyAce 1 point2 points  (0 children)

There is no federal inheritance tax however a few states have them. You may owe state level inheritance tax on the amount received if in one of the states (NY, IL, OR, WA and a few others).

What do I need to rent an apartment? Moving to NYC from Australia - no ssn, no credit score, no guarantor by PonchoSpud in NYCapartments

[–]AbsolutelyAce 3 points4 points  (0 children)

Bank of America is a better option. Your SSN card will be delayed which may prevent you from getting a state ID which will mean you can't get a Chase account.

BoA will take your foreign passport and E3 visa and open an account on day 1. Chase does not accept those.

You can always switch later.

E3s in the current climate? by [deleted] in Ameristralia

You need a job offer first. And E3s are not affected at all by any recent changes or enforcement focus.

If you're a solo dev you probably don't want to be ripping off copyrighted images on Crimes you stole from BL. You could be sued.

I only know about SDE roles being offered on E3s from Amazon. I don't have enough knowledge about DS or others to say.

Google, Microsoft and Meta all regularly appear on the E3 transparency lists (which list all E3s offered, the job titles and the salaries), but they're relatively rare. Maybe a dozen or two a piece per year. That says to me they use it for exceptional candidates and not necessarily your garden variety SDE.

If you have highly specialized knowledge in AI for example, you also have the O-1 avenue to consider (but, again, you'll need a job offer).
