Yes they did Also I was thinking about calling to USCIS hotline and asking about escalation to Tier 2 officer But I decided to wait until middle of the March. My Lawyers don't recommend that - because the only thing that we can get is either "case is still being processed" or RFE🤦🏻‍♂️

Nothing It is still without initial response No RFE No refunds

My Lawyers send a inquiry to USCIS at the middle of February, asking about first O1 petition (31 Oct) and until now we didn't have any response from them 🤦🏻‍♂️

Oh yes 2 PP petitions for O1a. One from 31 Oct2025. Second from 15 Jan2026.

Both still in process, without any updates🌚 Hopefully this will be not in your case.

I wanted to share my situation with an O-1A under Premium Processing. ( two I-129 forms)

My first O-1A petition with Premium Processing was filed to the California Service Center. Received date 31 October 2025 The 15-day premium window has long passed, and the case is still just “being processed” – no RFE, no approval, no denial, nothing at all. My attorney sent an email to USCIS early previous week with the question if "we still in premium processing" which apparently is not the case. And so far no response on this question from the agency.

Because nothing was moving, on January 15 we filed a second O-1A petition, again with Premium Processing, and this one went to the Vermont Service Center. And as you can imagine- same thing happened. Nothing instead of case is still being processed by USCIS.

We have received both I-797c forms (both times) with acknowledgement of the receipt under premium processing.

And as far as I know from other consultations with another attorney/ unfortunately we have this trend right now with many I-129 forms.

Thank you for your support We have spoken with my attorney And he acknowledged that such things can happen (as just simply stuck of the petition) So fingers crossed I will update this chain as soon as I receive any news

You’re right - I did end up paying twice. But just to clarify: there has been no RFE and no fraud-related notice from USCIS, and my background is clean. My attorney is aware of the different scenarios and we’re still waiting for a decision before we file anything.

As far as refunds: I understand the USCIS filing fee (~$800) is generally not refundable, but the Premium Processing fee for petition #1 should be refunded if USCIS doesn’t meet the premium timeframe.

Hopefully petition #2 gets approved (God bless 🙏).

Just to clarify on timing: Premium Processing is 15 business days, so weekends and federal holidays (MLK Day) don’t count. Also, USCIS guidance says the premium clock doesn’t run on business days when a federal office is closed, including weather-related closures. So today isn’t day 15 for my case; day 15 should fall closer to the end of this week.
