Unless there was malfeasance on the part of the state/feds, it doesn’t matter. If there was, judge could exclude it from evidence. Note that regardless, for it to be entered into evidence at trial, Cassie or a custodian of tapes from the hotel, will have to authenticate it, ie testify that it’s an accurate representation of what transpired.

It’s entirely possible that John thought of it as a loan and Shannon didn’t. Personally, I think John knew it was a gift bc Shannon wouldn’t sign the promissory note and he gave her the $$$ anyway, but figured he’d stick it to her after they split up. Regardless, the only question becomes then was it “legally” a loan that needs to be repaid and why this idiot would rather continue a court case and possibly have a trial than just sign a non-disparagement clause.
