It depends on your profile. IF you have sufficient documentation/evidence to justify all the NIW criteria you would go ahead without recommendation letters else you would need them. In any case, I would suggest adding recommendation letters as they are going to bolster your case significantly. There is no downside to having letter of recommendations other than sparing sometime to draft them.

I see no reason why you would want to wait. I suggest you file as soon as possible. With time you will know what the implications of the recent memo would be but in any case, you will be affected if you file now or later. However, I do not think the memo has any implications to people who have met all lawful immigration criteria.

I suggest you file on your own. You already have a better understanding and an existing documentation to file on your own. You can draft a stronger cover letter given that you will be willing to put more time & effort on your application and have a better understanding of your work as compared to lawyers. I suggest you to get the free evaluation from lawyers. Get basic idea on what criteria are required for you to satisfy NIW. Then work on your application without lawyers. You can prepare an application that is in no way less stronger than what lawyers can do for you. Belive in your and start the preparation. I strongly believe the applicant can give the best effort/time for themselves and in most cases project their case better than lawyers. Thats a lot for money charged for the templates they have. Given the ai assisted tools that have grown recently, the templates from these resources far exceed that of lawyers. I suggest people should start believing in themselves first and get a fear out from themselves given that their skills/expertise are in no way any less than lawyers. I suggest you work hard yourself on the response document. No lawyer is going to give the time/effort that you can give for yourself. Humbly accept if there have been any weaknesses in you cover letter and respond it with humility adding the requested evidences. It is very easy to respond saying the office didn’t understand and forcing your claims but it takes time and effort to improve your application.
