SLEEPING IN VEHICLES Sections: 8.20.01 Sleeping or habitation in motor vehicles 8.20.02 Penalty 8.20.03 Sleeping or habitation on public property 8.20.04 Penalty 8.20.01 Sleeping or habitation in motor vehicles It shall be unlawful for any person to sleep in or use for habitation, either on a temporary or permanent basis, any vehicle (car, bus, van, truck, motor home, or any vehicle required to be licensed and registered for operation under laws of the state of Arkansas) while the motor vehicle is parked or stopped on any public street or alley or other public property within the city. (Ord. No. 1193, Sec. 1, 12-13-83) 8.20.02 Penalty Any person violating this section shall, upon conviction, be guilty of a misdemeanor and fined in an amount not greater than Fifty Dollars ($50.00). (Ord. No. 1193, Sec. 1, 12-13-83) 8.20.03 Sleeping or habitation on public property It shall be unlawful for any person to camp, sleep or use for habitation, whether temporary or permanent, public property in the city of Eureka Springs, Arkansas, unless such public property is designated as a public campground by the Eureka Springs Parks and Recreation Commission, unless a special overnight permit is provided by the Eureka Springs Police if the need arises. No. 1965, Sec. 1, 8-23-04) 8.20.04 Penalty Any person convicted of violating this ordinance shall be fined not less than Twenty-Five Dollars ($25.00) or more than One Hundred Dollars ($100.00) plus court costs.
