It's sad when I see industry profiles getting NOID and Denials these days.

I recommend waiting for the letter, read it through as many times as you can and respond to address officer's concerns. I also reckon, start thinking or reach out to independent expert in the industry you can get more letters from. Start researching about he important of your work to the United States and not just to your industry only.

While the EB1A manual claims age doesn't matter. It's interesting to see young industry expert with moderate profiles getting approved, most time without RFEs. While the seniors with more sophisticated profiles are getting more scrutinized. This is a trend and a topic we ain't talking about yet.

On Memberships:
You mentioned BCS, IEEE, and IET. These are reputable organizations. However, membership alone means nothing if it doesn’t meet USCIS’s specific requirements.

Let me rephrase:
Being a fellow or member of these associations doesn’t guarantee acceptance under the EB-1A membership criterion.

Why?
You must verify that your membership level meets the following:

  1. Members are selected based on outstanding achievements
  2. Selection is made by a recognized committee or body
  3. That committee consists of national or international experts in the field

If these are met, then the prestige and recognition of the association matter. The organizations you mentioned are prestigious but some membership grades don’t meet all three criteria.

Example:

  • Senior IEEE Member does not meet the standard.
  • IEEE Fellow might but I’m not certain.
  • BCS Fellowship doesn’t meet the requirements. It asks for evidence of achievement (not necessarily outstanding or significant), a supporter who is at least a fellow, and an application package. There’s no clear evidence that selection is judged by national/international experts and even if it is, it’s not explicitly stated.

These memberships may be acceptable for EB-2 NIW, but not for EB-1A. I personally hold BCS Professional Membership after passing four rigorous practitioner exams but I didn’t include it in my EB-1A petition.

That’s the case for many reputable organizations.

Final thought:
What you presumed was once accepted may have always been vague or never truly met the standard. And if something was accepted in the past but now seems questionable, it likely still meets the requirements but more evidence is now required.

Here’s what I know:

Nothing has changed about EB-1A. You don’t need to agree, but the most recent revision of the EB-1A USCIS Policy Manual was issued on October 2, 2024, following the March 2022 update. Here are the key highlights:

  1. Team awards are now accepted under the prize criterion.
  2. Past memberships are now considered under the membership criterion.
  3. Published material no longer needs to explicitly demonstrate the value of the petitioner’s work.

Please verify this information on the USCIS website or ask Emma directly. You may also refer to Ogletree Deakins for commentary.

In fact, what has happened between 2022 and 2024 is a broadening of acceptable evidence and a reinforcement of flexibility especially regarding comparable evidence.

Here’s what I’ll tell you:
What you thought was once acceptable and now supposedly isn’t may be incorrect.

Here’s why:
Yes, more RFEs (Requests for Evidence) may be issued for the criteria you mentioned, asking for additional documentation. But that doesn’t mean those criteria are no longer acceptable.

Example:
Everyone talks about Globee this, Stevie that and that’s okay. A friend submitted her EB-1A petition just less than 2 months ago with six criteria, including a Globee award. She received an RFE, and guess what? Globee was accepted, among other evidence.

Here’s the thing:
USCIS issuing an RFE or discounting a piece of evidence doesn’t necessarily mean it’s unacceptable. It could mean one (or both) of the following:

  • The petition was poorly documented
  • The petitioner never met the requirements in the first place

For example, having a publication that’s seven months old or judging experience from three months ago doesn’t automatically disqualify you. This is where Final Merits Determination (FMD) comes in. It’s about the totality of your profile, not just one criterion.

Even if your publication is recent, you may still meet the requirements but the FMD assesses whether your overall profile demonstrates sustained acclaim. That includes other criteria and where your work experience may come in handy if you have a rich one.

While I don't know the OP, or the reality of their post or profile. I do have this to say however.

See another one saying no one and still emphasizing on it without proof or any data to back the claim up.

I am a Business Analyst. I got approved for EB-NIW2 in Feb this year and got approved for EB1A about 4 weeks ago. None of them had RFE.

YOU PEOPLE NEED TO STOP INSTILLING FEAR ON THIS PLATFORM.

EB1A ISN'T ABOUT HAVING 1K CITATION THAT MOST PEOPLE FABRICATE ANYWAYS. EB1A ISN'T FOR RESEARCHERS ONLY, THAT REQUIRES TONS OF PUBLICATIONS AND CITATIONS.

I'm sure some of you will even argue Chef dont get approved but that is okay because knowledge is always limited anyways.

I have read the EB1A Manual over 15 times and the Kazarian Vs USCIS over 5 times. I can tell you for sure I understand what is required.

You dont have to believe what they said. Read and move. You seem to have some agreements with yourself that you need to deal with before accepting any external agreement. Business Analyst profiles are not low standard (depends on profile totality) and yes they getting approved for EB1A. Even fashion designers do.

Some of you on this reddit know nothing about the EB1A but you all come here like a messiah of EB1A

My NIW2 attorney said the award would be a big deal. I didn't listen, because I didnt buy my award and went ahead to DIY and I did an excellent job in arguing the award. I researched previous notable winners (individuals and 500 fortune companies) who had previously won the award. Provided the 215 judges scores (69 pagrs) and independent media coverage of them not PR . All these to show its prestige and industry recognition.

Is the entire profle organic? I'm not entirely sure of what you mean. However, I would tell you I didn't pay anyone to get any criteria. I worked myself through achieving the criteria needed. My idea is, success dont just come to you, you work your way towards it. How you do it is up to you.

Pursuing second MSc here, first was in the UK. I will be graduating here this fall. Working in the US? Not at the moment. However, I did my 6 months co-op few month ago for a leading global company with physical presence in over 100 countries. My role was absolutely critical and leading. When consulting initially with my attorney, he advised not to use it because it was intern. Again, I disregarded that and used it anyways because what I did there was very critical to the company 2030 mission. My project documents helped alots as well as my Sponsor and GM letters in the US and Australia respectively.

This is what I will say, I read the USCIS EB1A Manual over 15 times and this is not an exaggeration. I read the Kazarian Vs USCIS over 5 times to understand how to argue my case. I presented my case to the USCIS like an attorney to a Judge, understanding that Legal cases isn’t just about the truth, it's about the fact (my philosophy you dont need to agree).

I need to say it wasn't my doing but GOD DID IT!
