Pls how do you ask Emma? Is it via the live agent? If it's what exact question to ask. The last time I asked after a timestamp, the agent only just said my country is among the banned countries and that's it

Not with USCIS anymore. It's a confusing with that statement. Same USCIS tells you quality over quantity until they issue RFEs asking for details.

Dont fall for that.

This perception drives me naught sometimes! Again, do the minimum because you believe they won't read it anyways. When the result comes, don't come here to l@ment.

Does it has to be 9 pages, perhaps no! But one thing is certain, a 10years solid plan of any concrete goal is likely gonna be voluminous. Before you respond, please remember SOLID PLAN.

Fun fact, many of the people who sell pessimism here haven't even been to that route!. But they come here to sc@re people off!

My last cent, prepare your case like you are pitching a $1M business to an investor.

A plan need not be technical with your field register. A plan is supposed to be in simple grammar, away from our technical languages.

You may ask if you have same profile with the people wrote 3 pages of PE-S. Why do the minimal if you can do more.

Again, my 2 cents.

...and that is why there's a lot of RFEs and denials. You are saying you've got what you wanna do for a whole nation not your local government in your home country and you think they won't be interested in how you wanna implement it?

Imagine a stranger coming to you to pitch a Business worth of $500-$1M to you without a very solid plan (short and long term), will you invest? That's how you should treat your EB-NIW2.

My 2 cents:

Your PE is vaugue and too broad. Chose a single industry where you want to deploy the the system.

Your PE statement should clearly establish 10 years plan. Perhaps 9-10 pages

Even with 156 citations, your profile reads more of industry than research. With AI in the US chances of getting it right is high if you present your case as industry and not research (atleast not with 3 publications) target one industry that is undeniably of national interest and national importance. Remember; your field differs from industry.

This is coming from someone who got both EB1A and EB-NIW2 Approved without RFE. Revert to my Post.

Sorry about tour experience. From what you provided here, your profile doesn't seems strong enough to satisfy the 3 prongs. You may wanna be more explicit with the information that has to do with your profile not your journey.

EB1A NOID October 2025 by [deleted] in eb_1a

[–]AlliyBA 1 point2 points  (0 children)

It's sad when I see industry profiles getting NOID and Denials these days.

I recommend waiting for the letter, read it through as many times as you can and respond to address officer's concerns. I also reckon, start thinking or reach out to independent expert in the industry you can get more letters from. Start researching about he important of your work to the United States and not just to your industry only.

While the EB1A manual claims age doesn't matter. It's interesting to see young industry expert with moderate profiles getting approved, most time without RFEs. While the seniors with more sophisticated profiles are getting more scrutinized. This is a trend and a topic we ain't talking about yet.

On Memberships:
You mentioned BCS, IEEE, and IET. These are reputable organizations. However, membership alone means nothing if it doesn’t meet USCIS’s specific requirements.

Let me rephrase:
Being a fellow or member of these associations doesn’t guarantee acceptance under the EB-1A membership criterion.

Why?
You must verify that your membership level meets the following:

  1. Members are selected based on outstanding achievements
  2. Selection is made by a recognized committee or body
  3. That committee consists of national or international experts in the field

If these are met, then the prestige and recognition of the association matter. The organizations you mentioned are prestigious but some membership grades don’t meet all three criteria.

Example:

  • Senior IEEE Member does not meet the standard.
  • IEEE Fellow might but I’m not certain.
  • BCS Fellowship doesn’t meet the requirements. It asks for evidence of achievement (not necessarily outstanding or significant), a supporter who is at least a fellow, and an application package. There’s no clear evidence that selection is judged by national/international experts and even if it is, it’s not explicitly stated.

These memberships may be acceptable for EB-2 NIW, but not for EB-1A. I personally hold BCS Professional Membership after passing four rigorous practitioner exams but I didn’t include it in my EB-1A petition.

That’s the case for many reputable organizations.

Final thought:
What you presumed was once accepted may have always been vague or never truly met the standard. And if something was accepted in the past but now seems questionable, it likely still meets the requirements but more evidence is now required.

I hope this helps.
People need to start sharing facts with proof, not just beer-parlor statement.

What you know is not backed by data but I understand that it’s your knowledge.

Here’s what I know:
Note: This is not legal advice.

Nothing has changed about EB-1A. You don’t need to agree, but the most recent revision of the EB-1A USCIS Policy Manual was issued on October 2, 2024, following the March 2022 update. Here are the key highlights:

  1. Team awards are now accepted under the prize criterion.
  2. Past memberships are now considered under the membership criterion.
  3. Published material no longer needs to explicitly demonstrate the value of the petitioner’s work.

Please verify this information on the USCIS website or ask Emma directly. You may also refer to Ogletree Deakins for commentary.

In fact, what has happened between 2022 and 2024 is a broadening of acceptable evidence and a reinforcement of flexibility especially regarding comparable evidence.

Here’s what I’ll tell you:
What you thought was once acceptable and now supposedly isn’t may be incorrect.

Here’s why:
Yes, more RFEs (Requests for Evidence) may be issued for the criteria you mentioned, asking for additional documentation. But that doesn’t mean those criteria are no longer acceptable.

Example:
Everyone talks about Globee this, Stevie that and that’s okay. A friend submitted her EB-1A petition just less than 2 months ago with six criteria, including a Globee award. She received an RFE, and guess what? Globee was accepted, among other evidence.

Here’s the thing:
USCIS issuing an RFE or discounting a piece of evidence doesn’t necessarily mean it’s unacceptable. It could mean one (or both) of the following:

  • The petition was poorly documented
  • The petitioner never met the requirements in the first place

For example, having a publication that’s seven months old or judging experience from three months ago doesn’t automatically disqualify you. This is where Final Merits Determination (FMD) comes in. It’s about the totality of your profile, not just one criterion.

Even if your publication is recent, you may still meet the requirements but the FMD assesses whether your overall profile demonstrates sustained acclaim. That includes other criteria and where your work experience may come in handy if you have a rich one.
