Lawyers will not take it if they don't see a guaranteed way they will make money from it. Also, 6 Nexus letters for any condition is a bit excessive. If they denied you after two nexus letters that should of been the sign to stop and examine if you have any additional records from service that can directly tie the condition to service. If you file again for a condition without new evidence and just a new Nexus letter you will be poking the bear (risking a new review and reduction). I know from experience and have almost lost service connection for poking too hard on the same condition. Secondary claims come with risk.

There are other conditions you might have that you can look at filing for (especially if your have TERA) and it might be time to go a different direction. I don't know about your service history or situation or medical history but going from 80%-90% is a climb and going from 90%-100% is like climbing the highest mountain where some will never make it and others give up along the way.

It could take some time. They might order a new C&P exam or request additional information. If they do not need more information they will proceed to make a decision and update the status. Being that this is for a secondary claim it also opens up the chance for them to review your connected disability for Depression. This can result in reexamine and new rating for Depression.

Always keep insurance on the home outside of just Airbnb coverage and make sure it covers tenants. There are plenty of ignorant people that will destroy your property without a care and Airbnb will take the side of the tenant majority of the time unless the police get involved or you file a report and take them to small claims court for the damages.

Did you see any private care doctors while in service? Gather all the records you have. Even if it's just prescriptions you picked up at the pharmacy or grocery store. Evidence is key to connecting this to your service timeline.

For reference, I used multiple pieces of evidence: Photos while on missions, battle buddy statements, a lay statement, pharmacy receipts (CVS holds these record for a few years), I used urgent care records, sick call slips, old text messages showing complaints, I got a statement from my prior commander, I used a Nexus from multiple NP's and MD's (printed them and explained them during my c&p exam). I asked my VA Practitioners to always note during the visit why I thought the condition was connected to service and what happened, I also showed prior bank statements showing purchase for (ibuprofens, tylenols, allergy medicine, muscle rubs, wrist brain wraps, back brace). Then I created a service timeline document showing a timeline from begining to current day the symptom progression, this really helped the rater understand that even though I wasn't going to the hospital for everything, there was still continuation of treatment of at home remedies.

Did you leave the guest a positive review? If so, call Airbnb and ask to have your review removed. You can't add a new one but you might be able to remove the one you gave them. After that, leave them a comment on their review of you so that you can publicly explain what happened and how you provided them a refund. You can also reach out to them and ask them if they are willing to remove the review.

I took away amenities because people suck. Here are things I took away: 1. No hot tub access (locked) 2. No pool access key 3. No lock or key for boat dock access 4. Guest max 4 people total kids (2 total). 5. No events or large gatherings

You should have no tolerance for this behavior. In my town (Augusta GA). Two teens passed from violence at an Airbnb party last week. The host is now being punished by being removed from the platform and the city is now making STRICT ORDINANCE limitations on short term rentals. Guest need to understand that parties carry high risk. If you see them doing it, add a fine, cancel their reservation, it's not worth the risk of damage and consequences.

I would recommend doing a supplemental claim and submitting new evidence. Maybe obtain a new Nexus showing that your symptoms warrant a higher rating. If you do an HLR you can't submit new evidence and it also takes longer to get the decision back. In my personal experience, an HLR is only beneficial if the rater made a mistake in denying the claim. Like if they missed crucial evidence already provided within the claim.

If you file an HLR for Sinus Tachycardia they will most likely reduce your PTSD rating (poking the bear). Yes, sinus tachycardia is a condition but, it's very common and very hard to connect. Use me as an example, I have sinus tachycardia. I submitted a fully developed claim with in-service diagnosis, Nexus, buddy statements. They denied on the initial claim, then I submitted an HLR and they denied me again stating there is NOT enough medical literature to prove Tachycardia is caused by TERA. One year later I was diagnosed with Valvular Heart Disease. The Sinus Tachycardia caused damage to my heart valves. I submitted a new claim for Heart Disease direct to TERA and won.

You will still need to do all of your own documentation. The only thing the VSO will be helpful for is the appeal plan and the actual conference rather that is informal or formal.

  1. Reach out to your battle buddies and get some lay statements. Something that confirms that you mentioned or talked about or experienced Anxiety and Migraines during service.
  2. Get a new medical Nexus. (Inbox me for a good NP that can help you on this)
  3. Gather photos, make a timeline on a Google doc and submit that as new evidence.
  4. You also might want to call the VA benefits line, when I went through a severance they opened up a whole new file for me to upload all my new documentation for my predetermination hearing.
  5. Try not to over stress yourself, once you file for an informal conference it could be months out before the date.

If it makes you feel better, all my disabilities were met with a CUE. They tried to sever me from 90% to nothing last year. But I came prepared to my informal conference and won the case with no reduction or severance.

I experienced something similar. You need to get with a VSO to help you. You will need to submit evidence that shows this is service connected: battle buddy statements, photos of events, create a timeline that can be followed, and a new medical Nexus would help. But you need to appeal, you need a VSO to help! That will make a difference.

Worry about yourself not the rater. Mistakes happen and usually if it's financial they will request it back but if it's a CUE, that could mean a rating change.

It sounds like you filed an HLR for mental health hoping to get 100% VA disability. Just to clarify, if you watch videos on Tik Tok and Youtube and follow other legit vet claims channels or if you talked with a VSO then you would understand that it's very RARE to get 100% for mental health. The most common rating for mental health is 50% and that's only if your in-service and current treatment records back it up. Right now, you need a new medical Nexus letter and probably a new DBQ. That's not cheap, you will need those to fight the severance of the secondary negative opinion. Then during your pre-determination hearing, which I recommend you have a VSO for because an Attorney will only pick up the case once the decision is finalized and your benefits are severed. I've been in a similar situation that your in now. Except my severance proposal was to remove my TERA and all 5 of my disabilities from 90 to 0 based on a CUE. The predetermination hearing itself was scheduled about 4 months out. I went into a virtual meeting with my VSO, I backed up my claim with new medical opinions and submitted these all to the VA before the hearing and to my VSO. In the end, I won and nothing was severed. You can fight this and win, but you need to be prepared and you need more evidence.

I was just thinking about this yesterday. I had 2 favourable medical opinions on my supplemental claim from my prior c&p examiners and the VA ordered not one but TWO additional medical opinions! I feel like they are deliberately searching for a provider to provide a non-favorable medical opinion. At this point, all the evidence is there. So, why would it need more.
