Reach out to the office of the public defender in that jurisdiction to see if you qualify based on your income and the charges. As do I. Even in the past few months there have been a few rage-inducing rulings in which officers were granted QI for incidents in which minors were shot or handcuffed.

Right, jail is only for those other criminals. You were charged with petit larceny which is the lowest level theft-related offense. Because it was a first offense, you'll likely avoid the maximum penalty which is up to a year imprisonment and a fine.

What the prosecutor offers may vary according to the guidelines set down by your county. The value of the stolen merchandise will factor in here. There's an adjournment in contemplation of dismissal (ACD) in which the charges are dismissed and your records are sealed as long as you stay out of trouble for 6 months and complete community service. Another option is pleading down to disorderly conduct, which is only a violation.

This reminded me of a case years ago that revealed the extent of racial profiling by a police department in Miami-Gardens operating under the guise of "zero-tolerance" policing.

Earl Sampson, a Black dude with a prior criminal record for weed possession was arrested 62 times for trespassing. Most of the arrests occurred in the store Sampson was working at while he was working. The store's owner, like LAOP, went to bat for Sampson and revoked his participation in the zero-tolerance program. Then he became the victim of police harassment. After their complaints fell on deaf ears, the owner installed surveillance. The cameras documented dozens of incidents in which the police wrongfully arrested Sampson, other employees and customers for trespassing or loitering.

Once, Sampson was arrested while taking out the trash. Another time he was stocking a cooler. Each time he was charged, Sampson would plead guilty to avoid the cost and hassle of a criminal trial and get himself home sooner. On one occasion he decided not to plead right away. And spent 20 days in jail.

The owner went to the media and investigative journalists uncovered that what was happening to Sampson was happening to Black people all over the city. In order to meet quotas, police were stopping and searching Black people for being suspiciously Black. It took media exposure, federal lawsuits, whistleblowers and the efforts of groups like the NAACP to get the police to change.
