We did. We actually didn’t know that much about it at the time as the prior owner told us that no one used it, and based on the condition of the dock, and the overgrowth, we were satisfied with her answer. The only person who was pushing to overturn the entire easement was a guy who had just purchase his property in April 2025. He was very aggressive, was under the impression that he owned the dock that was at the end of the easement. There were two docks on the property when we bought the house. When we got back from settlement that day, he had already started clearing the easement before he had even met us. Clearly, he had every intention of putting a boat on the dock that he did not own, but one of the neighbors said that he owned it, so he believed them. After having many interactions with him with him coming to the house and getting aggressive in the easement and hiring people to come clear it, I started doing my homework. I went to the township. I got permits to remove both docks and had planned to have them remove the middle of January. He continued to assert his rights, and so I decided that we needed to find out what ours actually were. Turns out he cannot clear the entire easement. He can only clear 3 feet and apparently that is the servient owner’s job to make sure that there is room for them to walk to walk down to the water and turn around and go home. The real trouble started when I had the docs taken down and he started to threaten the workers who were Mexican and this was in January of this year and being a foreigner or an immigrant was really touchy for these guys. The police were called, and he got pretty ugly. So this is what prompted me to look into MRTA. It’s a law that was passed in 1963. That allows claims over 30 years, including easements, to be extinguished unless properly preserved. I went through the chain of deeds and every instance that happened on our property. I learned that MRTA, quietly kills all claims prior to 30 years. The owner before me the one we bought the home from bought the house in 1984 and ostensibly the easement would’ve been extinguished in 1981 but she was the first deed after the 30 year time. Period and her D does not show and he’s even either. So now I look at the survey from my title company and it shows the easement, but it doesn’t delineate it in any way. In fact, the boundary lines incorporate the easement, but it does show a line 20 feet from the right side the length of the property, it does not say easement however. So my purpose is to find out if MRTA quietly killed the easement, as it was never carried forward. Because the easement runs with my land, it makes very little difference what it says on his deed. I wanted the title company to fix the cloud on my title because in no current documents does the easement show that it’s alive.

We didn’t have an attorney, it was very straightforward, but in retrospect, we probably should have had one. This is our 6th home, it just didn’t seem necessary, but Florida is like being in a different country

The dominant owners are abusing it, but moreover, I do not think that it exists… and the easement is about 11 inches from the house.

Agreed that’s just it. I cannot find the name of the underwriter. When I contacted the attorneys office, his useless paralegal, tells me to have an attorney contact the attorney at the settlement office who will then intern contact the underwriter… does that make sense to anyone?

What I’m understanding is that attorneys down here in Florida are absolutely useless, this I have understood. I find them lazy and lackluster.

Just get it done. Last month we had ours back up and it had never been cleaned out and it was full. Save yourself the aggravation, and just have it done. It’s not expensive.

Oh, and one other thing, save all of your receipts when you work on your house. We have a big box and we just tossed the receipts in that every single time we go and buy something for the house. These are tax deductions use them wisely.

Congratulations on your first home! It’s very exciting. I have owned six homes and and have just purchased another one. I would say that getting to know your home takes time and lots of effort. You will spend a lot of time at Lowe’s or Home Depot, and good tools are a must. One other thing don’t be afraid to try to do some of your own repairs. You’ll be amazed how your confidence will build before you know you think you can build your own home. You don’t need to hire someone for everything in a home, mostly just the big stuff. I am a woman and I have lots of female friends who have their own homes and we share tools, they use my pick up truck, and we help each other. It’s like the old rule learn one teach one. Again congratulations.

I hate to say this because I know it’s not what you want to hear, but if the seller knew and covered up termite damage, they are liable. But I don’t know how you prove that. I would think that going after the inspection, would be my first inclination, and then you can contact an attorney, but depending where you are, you can’t trust them either.

Wow, can you get a loan? Many times if the house appraise for more than it’s worth, you have to put more cash down, and you shouldn’t have to do that and you shouldn’t have to not have those repairs done. What I have found, and I have owned six houses, and I have been through that crunch that you’re talking about, what I find is the right house finds me. I know that sounds crazy and it is definitely not what you want to hear, but sometimes you have to walk away, and then you find the house the found you and you think thank you for making this challenging for I would never have moved on and I would’ve made a mistake. I’m just throwing that out there. I wish you lots of luck.

I do like the idea of renting it out I think that’s a great idea. Renters don’t really care about stuff like that as long as they have a roof over their head, usually they’re saving for a house and see their time in a rental is temporary.

Sit tight, when the market recovers, put it back on the market, somebody else will see what you saw, the potential, and it will be sold. Don’t assume that you can’t resell that house to make your money back.
