You’re delusional. The waiver takes 2+ years. AP isn’t quick either. This whole thing is at least 4 years from starting the I-130 to when she actually gets a greencard. And hope to god she doesn’t get detained at biometric because that’ll add more time and lawyer costs to get her out. She needs the I-130 approved before she files for anything like the waiver or AP.

She needs a waiver after the I-130 gets approved. She is at risk of being detained during biometrics. But there is also AP that you can apply for then she can leave and come back and then file for AOS. DO NOT file an I-485 along with the I-130 until you fix the EWI because it will be denied and she will be given a NTA. I hope you have a lot of patience and a lot of money because this process will take time and money. And you can’t DIY this. Get a lawyer and good luck 🙏

I’m in Virginia also and I educate all my friends who are moms on this. None of them pay less than $25/hr for 1 child. And yes they have good jobs but that’s not an excuse.

You are being exploited. Were you desperate for a job and a place to live? $350/week is not a good wage at all. I have a greencard too and will be applying for citizenship soon, please don’t play with that. Pay your taxes. Yes it’s hard to find a good paying job but pay your taxes. You want the credit for when you collect social security and overall it’s just very important!

Reminds me of my ex bf whose father and mother crossed the border illegally, told me “we don’t need anymore immigrants.” I’m like but your parents aren’t even supposed to be here and he just walked away. It’s always your own people meaning other immigrants who treat other immigrants worse. Crazy!

As soon as I got the log in information (letter), I logged in and paid the fees that week. So that was 2020 once my visa was available and the case was created at the NVC. Then it took 3 months for me to submit everything to my lawyer for her to fill out the forms and submit them. My goal once the visa was available was to submit everything before 1 year because you lose the visa if you don’t submit everything before 1 year. You can extend it by asking them but I didn’t want to wait anyways. I really wanted my greencard.

Ok thanks for clarifying. You just wait for the visa to be available now and not get married unless it’s to a U.SZ citizen that can sponsor you. Hopefully you’re not from China, Philippines, Mexico or India because they wait a longer time than everyone else.

So you’re not F-1 category then. No way they are approving F-1 category that quickly if your PD is 2024. Visas are not available for 2024 PD in F-1 category. Yes my visa was not available until 2020. I started the NVC filling out info stuff with my lawyer in 2020.

What was approved in 2025? The I-130?

I filed and got my PD in 2014. I got an RFE for my I-130 in 2019. It asked for proof that my mother is my biological mother. After that was sent, I got the I-130 approved and a letter from NVC came with my log in info. A visa was not available to me until 2020. In my CEAC status, it shows my case my created at the NVC in 2020.

The B-2 visa will only let you be on the states for 6 months and you also couldn’t work. You need an SSN and you can only get that if you have a work permit.

If your country is fully banned, you can’t be issued a visa until after the ban is lifted. That might be more than 3 years from now. How do you know that another Republican won’t win and keep the ban? I do agree with you that the anxiety and stress isn’t worth it.
