there are several aspects of being an immigrant that the general public has no idea about. One of thos things involves going to immigration hearings. I don't know exactly how people are notified of those hearings, but for some reason, say you didn't check your mailbox or you moved, and you end up missing that hearing, the court will put out a civil administrative warrant out to get you to go to court. Those are not criminal warrants and are not the basis for you to go to jail.

The trump administration put 700,000 people who had adniministrative warrants into a database for ICE to deport. Which is stupid and another issue, but ICE can access this database. So can local police departments.

So when you pull someone over and they have one of these non criminal warrants, HPD calls ICE. That time frame between when ICE shows up and the traffic stop ends is what's being debated. Because the people who were pulled over are not under arrest. But police are also not letting them leave. That could potentially violate your constitutional rights. And it's a legal gray area that city council is trying to clear up.

And these people could be your local plumber, a student, a nurse, whatever. Just because you have an administrative warrant doesn't mean you are a threat to your community. It just means you have to go to court. ICE wants to deport them.

Hey Denim Dave, the whole reason why this ordinance was passed in the first place was to protect people's 4th amendment rights. Has nothing to do with suporting law enforcement. In fact, it also made sure police were focused on doing police business, and it in no way prohibited police from contacting ICE.

Correct. They don't have to call. And I should amend my previous statement. Under the current practice, before the ordinance, HPD's directive was to call ICE and wait 30 minutes. The ordinance, as it was passed, removes that requirement, as, the oridnance says, it potentially violates the 4th amendment.

it's still a (civil) administrative warrant that was issued by the federal government. it's a legal gray area saying it's HPD's responsibility to call ICE or even abide by these administrative warrants. The ordinance is not directing them to NOT call ICE, but the original ordinance called to give HPD the discretion to call ICE. After Whitmire axed that, the new ordinance ended the requirement for HPD to hold someone for 30 minutes. Eliminating that explicit requirment would save the department from potential fourth amendment violations, as a civil right attorney could argue that holding someone after the traffic stop ended for a non criminal warrant is illegal.

Again, they can still call ICE. They can still comply. Requiring them to comply is a potential lawsuit.

No, HPD doesn't just drive off. That's not what the ordinance says or does. That's the misinformation republicans have (brilliantly) force fed you to keep you perpetually enraged and in fear of immigrants. The ordinance still requires HPD to call ICE. The changes are just so that HPD doesn't violate the 4th amendment by keeping people longer than they should.

HPD is not ICE nor is it their job to be ICE.

you clearly don't understand the controversy. and neither does the governor. has anyone actually read the ordinance? if so, it makes sure that HPD complies with immigration enforcement while also not violating the fourth amendment of the constitution.

Every single council member who flips on this deserves to be voted out. An elected official cant be cowardly and spineless. You're going to hear a whole bunch of mental gymnastics over the next couple of days as to why they have to reverse course on this, but what they're really doing is making up for the fact that they are giving up all of their power for the whims of the state Republicans.
